بَابٌ فِيمَنْ أَعْطَى عَطِيَّةً، ثُمَّ وَرِثَهَا .

وَعَنْ سِنَانِ بْنِ مَسْلَمَةَ أَنَّ رَجُلًا مِنَ الْمُهَاجِرِينَ تَصَدَّقَ بِأَرْضٍ ( لَهُ ) عَظِيمَةٍ عَلَى أُمِّهِ فَمَاتَتْ وَلَيْسَ لَهَا وَارِثٌ غَيْرُهُ ، فَأَتَى النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَقَالَ : إِنَّ أُمِّي فُلَانَةً كَانَتْ مِنْ أَحَبِّ النَّاسِ إِلَيَّ وَأَعَزِّهِ عَلَيَّ ، وَإِنِّي تَصَدَّقْتُ عَلَيْهَا بِأَرْضٍ ( لِي ) عَظِيمَةٍ فَمَاتَتْ وَلَيْسَ لَهَا وَارِثٌ غَيْرِي ، فَكَيْفَ تَأْمُرُنِي أَنْ أَصْنَعَ بِهَا ؟ فَقَالَ : " أَوْجَبَ اللَّهُ أَجْرَكَ وَرَدَّ عَلَيْكَ أَرْضَكَ ، اصْنَعْ مَا شِئْتَ " .
رَوَاهُ الطَّبَرَانِيُّ ، وَرِجَالُهُ ثِقَاتٌ .

Sinan bin Maslamah narrates: A man from the Muhajirun gave a large piece of land of his to his mother as charity. She died, and she had no heir other than him. He came to the Prophet (peace and blessings be upon him) and said: My mother, so-and-so, was the most beloved and most dear of people to me. I gave her a large piece of land as charity; she has died, and she has no heir other than me. So what do you instruct me? What should I do with this land? The Prophet (peace and blessings be upon him) said: "Allah Almighty has made your reward certain and has returned your land to you; now do whatever you wish."
Al-Tabarani recorded it, and its narrators are thiqat (trustworthy).
