Book of Oaths and Vows
بَابُ لَا نَذْرَ فِي مَعْصِيَةٍ إِنَّمَا النَّذْرُ مَا ابْتُغِيَ بِهِ وَجْهُ اللَّهِ .
There is no vow in disobedience; a vow is only that by which the Face of Allah is sought

وَعَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ قَالَ : حَفِظْتُ لَكُمْ مِنْ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - سِتًّا : " لَا طَلَاقَ إِلَّا مِنْ بَعْدِ نِكَاحٍ ، وَلَا عَتَاقَ إِلَّا مِنْ بَعْدِ مِلْكٍ ، وَلَا وَفَاءَ لِنَذْرٍ فِي مَعْصِيَةٍ " .
قُلْتُ : وَهُوَ بِتَمَامِهِ فِي الطَّلَاقِ .
رَوَاهُ الطَّبَرَانِيُّ فِي الصَّغِيرِ ، وَرِجَالُهُ ثِقَاتٌ .
قُلْتُ : وَهُوَ بِتَمَامِهِ فِي الطَّلَاقِ .

Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) narrated: I have preserved for you six things from the Prophet (peace and blessings be upon him): "The right to divorce exists only after marriage; freeing a slave is only after ownership; and a vow concerning disobedience is not fulfilled." (Allamah al-Haythami says:) I say: This narration in full will come in the chapter on divorce.
