Majma al-Zawaid — Hadith 6842

وَعَنْ أَبِي هُرَيْرَةَ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لَا تَحِلُّ اللُّقَطَةُ . مَنِ الْتَقَطَ شَيْئًا فَلْيُعَرِّفْهُ ، فَإِنْ جَاءَ صَاحِبُهَا فَلْيَرُدَّهَا إِلَيْهِ ، فَإِنْ لَمْ يَأْتِ فَلْيَتَصَدَّقْ بِهَا ، فَإِنْ جَاءَ فَلْيُخَيِّرْهُ بَيْنَ الْأَجْرِ وَبَيْنَ الَّذِي لَهُ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الصَّغِيرِ ، وَالْأَوْسَطِ ، وَفِيهِ يُوسُفُ بْنُ خَالِدٍ السَّمْتِيُّ ، وَهُوَ كَذَّابٌ .
Sayyiduna Abu Hurayrah (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "A found item is not lawful. Whoever picks up such a thing must announce it. If its owner comes, he must hand it over to him; and if its owner does not come, he must give it in charity. Then, if its owner comes, he must give that owner the choice between the reward and having the thing returned to him."
Al-Tabarani recorded it in al-Mu'jam al-Saghir and al-Mu'jam al-Awsat; its chain contains a narrator, Yusuf bin Khalid al-Samti, who is kadhdhab (a liar).
