Majma al-Zawaid — Hadith 6811

عَنِ ابْنِ عَبَّاسٍ قَالَ : كَانَ الْعَبَّاسُ بْنُ عَبْدُ الْمُطَّلِبِ إِذَا دَفَعَ مَالًا مُضَارَبَةً اشْتَرَطَ عَلَى صَاحِبِهِ أَنْ لَا يَسْلُكَ بِهِ بَحْرًا ، وَلَا يَنْزِلَ بِهِ وَادِيًا ، وَلَا يَشْتَرِيَ بِهِ ذَاتَ كَبِدٍ رَطْبَةٍ ، فَإِنْ فَعَلَ فَهُوَ ضَامِنٌ ، فَرُفِعَ شَرْطُهُ إِلَى رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَأَجَازَهُ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ أَبُو الْجَارُودِ الْأَعْمَى ، وَهُوَ مَتْرُوكٌ كَذَّابٌ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: When Sayyiduna Abbas bin Abd al-Muttalib (may Allah be pleased with him) gave his wealth as mudarabah (a profit-sharing investment), he would stipulate to the other party that he would not take it on a sea voyage, would not camp with it in a valley, and would not buy any living creature with it; if he did so, then he would be liable (in case of loss). This condition was presented before the Prophet (peace and blessings be upon him), and he approved it.
Imam Tabarani recorded it in al-Mu'jam al-Awsat; its chain contains a narrator, Abu al-Jarud the blind, and he is matruk (abandoned) and a kadhdhab (liar).
