Majma al-Zawaid — Hadith 6052

عَنِ ابْنِ عُمَرَ يَرْفَعُهُ إِلَى النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " كُلُّ دَابَّةٍ مِنْ دَوَابِّ الْبَرِّ ، وَالْبَحْرِ لَيْسَ لَهُ دَمٌ يَتَفَصَّدُ فَلَيْسَتْ لَهُ ذَكَاةٌ " .
رَوَاهُ أَبُو يَعْلَى ، وَالطَّبَرَانِيُّ فِي الْكَبِيرِ إِلَّا أَنَّهُ قَالَ : " يَنْعَقِدُ " .
وَفِيهِ سُوَيْدُ بْنُ عَبْدِ الْعَزِيزِ ، وَهُوَ مَتْرُوكٌ .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) reports this from the Prophet (peace and blessings be upon him) as a marfu' hadith (attributed to the Prophet): He said: "Every creature of the land and the sea that has no (flowing) blood does not require (ritual) slaughter."
Abu Ya'la recorded it, and al-Tabarani in al-Mu'jam al-Kabir, but he differed in one word, "yan'aqidu". Its chain contains Suwayd bin Abd al-Aziz, who is matruk (abandoned).
