بَابٌ فِيمَنْ نَامَ عَلَى سَطْحٍ بِغَيْرِ تَحْجِيرٍ أَوْ رَكِبَ الْبَحْرَ عِنْدَ ارْتِجَاجِهِ
One who sleeps on a roof without a parapet or sails the sea when it is rough

عَنِ ابْنِ عِمْرَانَ الْجَوْنِيِّ قَالَ : حَدَّثَنِي بَعْضُ أَصْحَابِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - وَغَزَوْنَا نَحْوَ فَارِسٍ ، فَقَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " مَنْ بَاتَ فَوْقَ بَيْتٍ لَيْسَ لَهُ إِجَارٌ ، فَوَقَعَ فَمَاتَ ، بَرِئَتْ مِنْهُ الذِّمَّةُ ، وَمَنْ رَكِبَ الْبَحْرَ عِنْدَ ارْتِجَاجِهِ ، فَقَدْ بَرِئَتْ مِنْهُ الذِّمَّةُ " . رَوَاهُ أَحْمَدُ عَنْ شَيْخِهِ إِبْرَاهِيمَ بْنِ الْقَاسِمِ ، وَلَمْ أَعْرِفْهُ .
Abu Imran al-Jawni narrates: One of the Companions narrated this hadith to me while we were taking part in a campaign towards Persia. He said that the Prophet (peace and blessings be upon him) said: "Whoever sleeps on the roof of a house that has no raised edges, and then falls and dies, the (divine) protection is free of him; and whoever travels by sea when it is stormy, the protection is free of him."
This narration was recorded by Imam Ahmad from his teacher Ibrahim bin al-Qasim, and I do not know him.
