بَابٌ فِيمَنْ قَامَ مِنْ مَجْلِسٍ ثُمَّ رَجَعَ إِلَيْهِ
One who gets up from his seat and then returns to it

وَعَنِ ابْنِ عُمَرَ قَالَ :
نَهَى رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - أَنْ يَخْلُفَ الرَّجُلُ الرَّجُلَ فِي مَجْلِسِهِ ، وَقَالَ : " إِذَا رَجَعَ فَهُوَ أَحَقُّ بِهِ " .
رَوَاهُ أَحْمَدُ وَالْبَزَّارُ ، وَرِجَالُهُ ثِقَاتٌ إِلَّا أَنَّ ابْنَ إِسْحَاقَ مُدَلِّسٌ .

Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) states: The Prophet (peace and blessings be upon him) forbade that when a person gets up from his place, another person should sit in his place, and he said: When that person returns, he has more right to his place.
Ahmad and al-Bazzar recorded it; its narrators are thiqat (trustworthy), except that the narrator Ibn Ishaq is a mudallis.
