Majma al-Zawaid — Hadith 12299

وَعَنْ عَامِرٍ الشَّعْبِيِّ قَالَ : لَمَّا قَاتَلَ مَرْوَانُ الضَّحَّاكَ بْنَ قَيْسٍ أَرْسَلَ إِلَى أَيْمَنَ بْنِ خُرَيْمٍ الْأَسَدِيِّ ، فَقَالَ : إِنَّا نُحِبُّ أَنْ تُقَاتِلَ مَعَنَا . فَقَالَ : إِنَّ أَبِي وَعَمِّي شَهِدَا بَدْرًا فَعَهِدَا إِلَيَّ أَنْ لَا أُقَاتِلَ أَحَدًا يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ ، فَإِنْ جِئْتَنِي بِبَرَاءَةٍ مِنَ النَّارِ قَاتَلْتُ مَعَكَ . فَقَالَ : اذْهَبْ ، وَوَقَعَ فِيهِ وَسَبَّهُ ، فَأَنْشَأَ أَيْمَنُ يَقُولُ :
وَلَسْتُ مُقَاتِلًا رَجُلًا يُصَلِّي عَلَى سُلْطَانِ آخَرَ مِنْ قُرَيْشٍ
لَهُ سُلْطَانُهُ وَعَلَيَّ إِثْمِي
مَعَاذَ اللَّهِ مِنْ جَهْلٍ وَطَيْشِ .
أُقَاتِلُ مُسْلِمًا فِي غَيْرِ شَيْءٍ فَلَيْسَ بِنَافِعِي مَا عِشْتُ عَيْشِي
رَوَاهُ أَبُو يَعْلَى وَالطَّبَرَانِيُّ بِنَحْوِهِ ، إِلَّا أَنَّهُ قَالَ : " وَلَسْتُ بِقَاتِلٍ رَجُلًا يُصَلِّي " . وَقَالَ : " مَعَاذَ اللَّهِ مِنْ فَشَلٍ وَطَيْشِ " . وَقَالَ : " أَأَقْتُلُ مُسْلِمًا فِي غَيْرِ جُرْمٍ " .
وَرِجَالُ أَبِي يَعْلَى رِجَالُ الصَّحِيحِ ، غَيْرُ زَكَرِيَّا بْنِ يَحْيَى زَحْمَوَيْهِ وَهُوَ ثِقَةٌ .
Amir al-Sha'bi narrates: When Marwan intended to fight al-Dahhak bin Qays, he sent a message to Sayyiduna Ayman bin Khuraym al-Asadi (may Allah be pleased with him) and said: "Would you like to take part in the fighting with us?" He replied: "My father and my uncle had the honour of taking part in the Battle of Badr, and the two of them instructed me that I should not fight any person who bears witness that there is no god except Allah Almighty. If you bring me (some decree of) deliverance from Hell, then I will fight alongside you." He said: "You may go," and he criticised him and reviled him. Then Sayyiduna Ayman bin Khuraym al-Asadi (may Allah be pleased with him) composed these verses: "I will not fight a man who offers prayer, when the purpose of the fighting is merely the rule of a man from Quraysh. He will get his rule, and the sin will be binding upon me. I seek refuge in Allah from ignorance and recklessness. Shall I fight a Muslim without any reason? That will bring me no benefit, however long I may live."
Abu Ya'la recorded this narration, and al-Tabarani recorded something similar, except that he recorded these words: "I will not kill any person who offers prayer." And in it are these words: "Refuge is with Allah from faltering and recklessness." And in it are also these words: "Shall I kill a Muslim without any crime?"
Abu Ya'la recorded this narration, and its narrators are the narrators of the Sahih, except for Zakariyya bin Yahya Zahmawayh, and he is thiqah (trustworthy).
