Majma al-Zawaid — Hadith 10663

عَنْ مُحَمَّدِ بْنِ حَاطِبٍ - أَوِ الْحَارِثِ - قَالَ : ذَكَرَ ابْنُ الزُّبَيْرِ فَقَالَ : طَالَمَا حَرَصَ عَلَى الْإِمَارَةِ ، قُلْتُ : وَمَا ذَاكَ ؟ قَالَ : أُتِيَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - بِلِصٍّ ، فَأَمَرَ بِقَتْلِهِ ، فَقِيلَ : إِنَّهُ سَرَقَ ، فَقَالَ : " اقْطَعُوهُ " .
ثُمَّ جِيءَ بِهِ بَعْدَ ذَلِكَ إِلَى أَبِي بَكْرٍ ، وَقَدْ قُطِعَتْ قَوَائِمُهُ ، فَقَالَ أَبُو بَكْرٍ : مَا أَجِدُ لَكَ شَيْئًا إِلَّا مَا قَضَى فِيكَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - يَوْمَ أَمَرَ بِقَتْلِكَ فَإِنَّهُ كَانَ أَعْلَمَ بِكَ ، فَأَمَرَ بِقَتْلِهِ أُغَيْلِمَةً مِنْ أَبْنَاءِ الْمُهَاجِرِينَ أَنَا فِيهِمْ ، فَقَالَ ابْنُ الزُّبَيْرِ : أَمِّرُونِي عَلَيْكُمْ . فَأَمَّرْنَاهُ عَلَيْنَا فَانْطَلَقْنَا بِهِ إِلَى الْبَقِيعِ فَقَتَلْنَاهُ .
رَوَاهُ أَبُو يَعْلَى ، وَرِجَالُهُ ثِقَاتٌ إِلَّا أَنِّي لَمْ أَجِدْ لِيُوسُفَ بْنِ يَعْقُوبَ سَمَاعًا مِنْ أَحَدٍ مِنَ الصَّحَابَةِ .
Muhammad bin Hatib, or perhaps Muhammad bin al-Harith, narrates: He mentioned Sayyiduna Abdullah bin al-Zubayr (may Allah be pleased with him) and said that he had long been eager for leadership. The narrator says: I asked: "What is the reason for that?" He said: Once a thief was brought before the Prophet (peace and blessings be upon him), and he ordered that he be killed. It was said: "He has stolen." The Prophet (peace and blessings be upon him) said: "Cut off his hand." Then, after that, this thief was brought to Sayyiduna Abu Bakr (may Allah be pleased with him), and all his limbs had already been cut off. Sayyiduna Abu Bakr (may Allah be pleased with him) said: "I find nothing for you except what the Prophet (peace and blessings be upon him) decreed regarding you on the day he ordered you to be killed, for the Prophet (peace and blessings be upon him) knew you better." Then Sayyiduna Abu Bakr (may Allah be pleased with him) ordered some young men from the sons of the Muhajirun to kill him, and I was among them. Sayyiduna Abdullah bin al-Zubayr (may Allah be pleased with him) said to them: "Make me your leader." So we made him our leader, then we took the thief to al-Baqi' and killed him.
Abu Ya'la recorded it, and its narrators are thiqat (trustworthy), except that I have not found that Yusuf bin Ya'qub heard from any of the Companions.
