بَابُ : مَنْ زَوَّجَ ابْنَتَهُ وَهِيَ كَارِهَةٌ

حَدَّثَنَا أَبُو السَّقْرِ يَحْيَى بْنُ يَزْدَادَ الْعَسْكَرِيُّ ، حَدَّثَنَا الْحُسَيْنُ بْنُ مُحَمَّدٍ الْمَرْوَذِيُّ ، حَدَّثَنِي جَرِيرُ بْنُ حَازِمٍ ، عَنْ أَيُّوبَ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ : " أَنَّ جَارِيَةً بِكْرًا أَتَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَذَكَرَتْ لَهُ أَنَّ أَبَاهَا زَوَّجَهَا وَهِيَ كَارِهَةٌ ، فَخَيَّرَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " .
´It was narrated from Ibn Abbas that:` a virgin girl came to the Prophet and told him that her father arranged a marriage that she did not like, and the Prophet gave her the choice.
حَدَّثَنَا مُحَمَّدُ بْنُ الصَّبَّاحِ ، أَنْبَأَنَا مُعَمَّرُ بْنُ سُلَيْمَانَ الرَّقِّيُّ ، عَنْ زَيْدِ بْنِ حِبَّانَ ، عَنْ أَيُّوبَ السَّخْتِيَانِيِّ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، مِثْلَهُ .
With this chain also, it is narrated from Ibn Abbas (may Allah be pleased with them both) in a similar manner, as a marfu‘ (attributed to the Prophet).

«أخرجه أبوداود، النكاح، باب في البكر يزوجها أبوها ولا يستأمرها، حديث:2096، وابن ماجه، النكاح، حديث:1875، وأحمد:1 /273.»©Explanation:
From this hadith, it is understood that although the father is the guardian (wali), if he contracts the marriage of the girl without her permission and consultation, then the girl is legally (shar'an) entitled that if she is displeased with this marriage, she may annul it.
