❖ Ruling on Inheritance When the Deceased Leaves Debt Equal to His Estate ❖
❓ Question:
If a businessman passes away while being in debt to the market, and the value of his business assets equals the amount of debt he left behind — will he be held accountable for this debt in the Hereafter? What is the Sharʿī ruling regarding his estate?
📝 Answer by: Shaykh Ikrāmullah Wāḥidī (حفظه الله)
📌 Ruling on Debt and Inheritance Distribution
According to Islamic law:
❶ The first obligation upon the deceased’s estate is to settle all debts.
❷ If, after paying off the debts, any wealth remains, only then it will be distributed among the heirs.
❸ If the entire estate is consumed by debt, and no surplus remains, then there will be no inheritance to distribute.
📖 Based on Qur’anic and Prophetic Guidance
The Qur’an states:
“…after the payment of any bequest he may have made or debt…”
[Surah An-Nisā’: 11]
This clearly indicates that debt repayment precedes inheritance.
⚖ Accountability in the Hereafter
If the deceased:
- Intentionally and unjustly took loans without intent to repay, or
- Misused funds,
then he may be held accountable in the Hereafter.
However, if:
- The debt was business-related,
- He intended to repay but passed away before doing so,
- And left behind assets equal to the debt,
then his estate should be used to clear the debt, and he is not sinful, provided the repayment process was in motion or planned.
✅ Conclusion
✔ Debt must be paid from the estate before any inheritance is given.
✔ If the estate equals the debt, then there is no inheritance, and the heirs receive nothing.
✔ The deceased will not be sinful, if the debt was legitimate and he intended repayment, and it is settled from his assets after death.
