Question:

A woman reports about her husband that he never prays, sometimes he prays the Friday prayer, he continuously consumes alcohol and other intoxicants, and when this woman stands for prayer, he mocks her. Is it permissible for this woman to remain married to such a husband?

Answer:

When the husband is as described, it is not permissible for his Muslim and prayer-observant wife to remain with him in marriage, because her husband has become a disbeliever due to abandoning prayer and mocking those who pray. Indeed, Allah Almighty has said:

“Then if you know that they are believers, do not return them to the disbelievers; nor are those women lawful for them, nor are they lawful for those women.”
Therefore, it is obligatory upon the mentioned woman to, to the best of her ability, use legitimate Islamic means to free herself from him. And success is from Allah
