Zakat Ruling on Rental Houses, Unused Land, and Plots
Source: Ahkam wa Masail, Vol. 01, in the light of the Qur’an
❖ Question
I own two houses from which I receive monthly rent of Rs. 7,000, and all my family expenses are covered from this amount.
In addition, I have 4 acres of land which is currently barren and uncultivated, as well as one plot of 300 yards/meters that has not yet been constructed.
How much zakat is obligatory on all this property?
❖ Answer
Al-ḥamdu lillāh, waṣ-ṣalātu wa-salāmu ʿalā Rasūlillāh, ʿAmma Baʿd!
➊ Zakat on Rental Houses
- Zakat is not due on the value of the rented property itself.
- Rather, zakat is due on the rental income, provided that:
- The rental income reaches the nisab, and
- It remains saved (unspent) for a full year.
- Since your rent is consistently consumed in family expenses, no zakat is due on this income.
➋ Zakat on Agricultural Land
- Zakat is not obligatory on the value of agricultural land itself.
- According to Sharīʿah, zakat applies only on the produce of the land (ʿushr).
- Since your land is currently barren and uncultivated, no zakat is due.
➌ Zakat on Unconstructed Plot
- If you purchased this plot with commercial intent (i.e., to sell later for profit):
- Then if its market value reaches the nisab,
- You must pay 2.5% zakat each year based on its current market value.
- If you purchased this plot for personal residential use,
- Then no zakat is due, as Sharīʿah does not obligate zakat on personal houses or residential plots.
➡ In this matter, your intention is decisive, and Allah ﷻ knows the reality of intentions.
