Definition and Explanation of Takhāruj (تخارج) in Islamic Inheritance

✿ Linguistic Meaning:

Takhāruj (تخارج) literally means:
➡ “To separate from one another.”

✅ Sharʿī Definition:

“When a legal heir withdraws from the inheritance by accepting a known item (or value) in exchange for his/her share, this is called Takhāruj or Ikhrāj.”

❖ Explanation:

When one of the heirs agrees to take a specific item from the estate in exchange for forfeiting their full share,
👉 that heir is still counted in the original legal distribution (mas’alah) for calculation purposes,
👉 but after computing, their share is removed and the remaining estate is divided among the other heirs accordingly.

📌 Important Notes:

① If the withdrawing heir is excluded at the start, the shares of the remaining heirs may become unbalanced — some may receive less or more than their rightful amount.

▶ Example:
If a maternal brother is removed outright from the calculation,
→ the husband’s share becomes less than his rightful portion,
→ while the full brother’s share becomes excessive.

② Takhāruj is not permissible if the entire estate is consumed by debts.

③ Takhāruj can also occur among creditors,
e.g.,

  • Nazeer is owed ₹20,
  • Khalil ₹30,
  • Basheer ₹40.
If Basheer accepts an item and exits the debt pool,
→ the remaining ₹50 are divided among the rest based on their entitlement.
