✿ The Rule: Buyer and Seller Have the Right to Cancel the Sale Until They Part

Islamic jurisprudence grants a conditional right to both the seller and the buyer to cancel a sale as long as they remain in the same gathering (majlis) and have not yet physically separated.

✿ ① Hadith Evidence:

❶ Narrated by Hazrat Hakim bin Hizam (رضي الله عنه):

“البيعان بالخيار ما لم يتفرقا”

“The two parties involved in a sale have the option to cancel the sale as long as they do not separate.”
[Bukhari: 2079; Muslim: 1533; Abu Dawud: 3500; Nasa’i: 4474; Muwatta: 2/685]

❷ Narrated by Hazrat Ibn Umar (رضي الله عنهما):

“المتبايعان كل واحد منهما بالخيار على صاحبه ما لم يتفرقا إلا بيع الخيار”

“The buyer and the seller each have the right (to cancel the sale) so long as they do not part, except in a sale with an option (Bay’ al-Khiyar).”
[Bukhari: 2107; Muslim: 1531; Muwatta: 2/671; Abu Dawud: 3454; Tirmidhi: 1245; Sharh Ma’ani al-Athar: 4/12]

Bay’ al-Khiyar means a sale in which the seller has given the buyer an option (or vice versa), in which case the option remains valid even after physical separation, until the set period expires.

✿ Interpretation of “Separation” (تفرق):

There is a scholarly difference on whether “separation” refers to:

  • Physical separation (تفرق بالأبدان) – Actual bodily parting
  • Verbal conclusion (تفرق بالأقوال) – Conclusion of the discussion

✿ Scholars Who Support

✔ Companions and Tabi‘in:
Abu Barzah Aslami, Ibn Umar, Ibn Abbas, Abu Hurairah (رضي الله عنهم), and later scholars such as Imam Shurayh, Al-Sha’bi, Tawus, ‘Ata, Sa‘id ibn al-Musayyib, Al-Zuhri, Al-Awza‘i, Hasan al-Basri, among others.

✔ Major Imams:
Imam Shafi‘i, Imam Ahmad, Imam Ishaq, and Imam Abu Thawr (رحمهم الله) – All supported the opinion that as long as both parties remain in the same gathering, they retain the right to cancel the transaction.

Imam Ibn Hazm (رحمه الله) even stated emphatically that only Ibrahim al-Nakha‘i opposed this view among the Tabi‘in.

✿ Scholars Who Support

✔ The Hanafi and Maliki schools (except Ibn Habib), and Ibrahim al-Nakha‘i (رحمه الله) – They hold that the right to cancel ends as soon as the transaction is verbally concluded, even if both parties are still present together.

✿ Analysis and Preferred View:

According to many scholars, including Ibn Hajar (رحمه الله), the correct and stronger opinion (راجح) is that the right remains until physical separation, based on the explicit wording of the Hadith.

He further noted:
“Among the Companions, no known dissenting view exists against this position (held by Ibn Umar and Abu Barzah).”

Even among the Hanafis, the author of al-Ta‘liq al-Mumajjad acknowledged this and refuted all contrary Hanafi arguments.

✿ Conclusion:

The most accurate position, supported by strong Hadith evidence and the consensus of numerous early scholars, is that as long as the seller and buyer have not physically separated, they retain the right to cancel the sale. This ruling promotes fairness and protects both parties in the transaction.
