Question:
What is the ruling on a person who commits a forbidden act with his wife during the month of Ramadan? What if he does it while fasting and what if he does it at night? And what is the expiation for it?
Answer:
If a person has intercourse with his wife during the month of Ramadan between sunset and dawn, then there is no sin on him. However, if he has intercourse with his wife during the daytime, between dawn and sunset, then he is sinful and disobedient to Allah and His Messenger ﷺ. Both making up the fast (qadha) and expiation (kaffarah) are obligatory on him. The expiation is as follows:
(1) Freeing a slave (2) If he cannot find a slave, then fasting continuously for two months (3) If he is unable to do that, then feeding sixty poor people. From the common food of his country, which the people of his area eat, half a sa’ (approximately one and a quarter kilograms) to each poor person.
