Shariah Position Regarding Relations with Relatives and Mirzais
Question:
It is said that we are Muslims, but despite this, we establish relations with Mirzais. For example, a boy and a girl’s marriage was solemnized in Rabwah, while another marriage took place in Maulana Shauq’s mosque Noor Park. Now the boy is getting married into a Mirzai family. In such a case, is it permissible to attend the wedding procession and eat and drink there or not?
Answer:
Shariah and Legal Ruling on Mirzais
Mirzais, whether Qadiani or Lahori, both groups are disbelievers. There is no doubt about their disbelief, because the scholars had issued a fatwa on their disbelief even before the partition of India.
◈ Sheikh-ul-Islam Hazrat Abu Al-Wafa Sanaullah Amritsari (may Allah have mercy on him) clarified this issue in his book Faskh-e-Nikah Mirzaiyan.
◈ This treatise bears the signatures of prominent scholars from Ahl-e-Hadith, Hanafi, Deobandi, Barelvi, and other schools of thought.
◈ It has been proven in the light of arguments and evidence that:
✿ A Muslim woman cannot marry a Mirzai man.
✿ A Muslim man is not permitted to marry a Mirzai woman.
✿ If a person becomes Mirzai and his wife is not Mirzai, then the marriage is automatically annulled.
Maulana Muhammad Hussain Batalvi (may Allah have mercy on him) issued the first unanimous fatwa on the disbelief of the Mirzais in his newspaper Isha’at-us-Sunnah, which included fatwas from scholars of all schools of thought.
Furthermore:
◈ Judges of Bahawalpur and Rawalpindi (for example, Judge Muhammad Akbar) declared Mirzais as disbelievers.
◈ The National Assembly of Pakistan declared both Qadianis and Lahoris as disbelievers and non-Muslims in September 1974.
◈ The Muslim world has also endorsed this decision.
Therefore, marriage, social interaction, and kinship with Mirzais are religiously and legally invalid.
In the Light of the Holy Quran
Prohibition of marriage with disbelievers:
﴿وَلا تُمسِكوا بِعِصَمِ الكَوافِرِ﴾
“Do not marry disbelieving women.”
“Do not give your women in marriage to disbelieving (polytheist) men.”
These verses clearly indicate that marriage with Murzais is absolutely forbidden. A person who does so is practically denying the verses of the Quran, which falls under the category of disbelief.
Participation in Murzai Marriages and Eating and Drinking with Them
Attending Murzai weddings, going to their processions, or eating and drinking at their places is strictly impermissible because this act is equivalent to encouraging their disbelief.
Instructions of the Holy Quran
Prohibition of Friendship with Jews and Christians:
﴿يـٰأَيُّهَا الَّذينَ ءامَنوا لا تَتَّخِذُوا اليَهودَ وَالنَّصـٰرىٰ أَولِياءَ…﴾
“O you who believe! Do not take the Jews and Christians as allies… whoever takes them as allies is one of them.”
Imam Shawkani writes in his Tafsir:
“… This friendship is the way of disbelievers, not Muslims. Whoever among Muslims befriends them will also be included among them.”
Cutting ties even with close relatives:
﴿يـٰأَيُّهَا الَّذينَ ءامَنوا لا تَتَّخِذوا ءاباءَكُم وَإِخوٰنَكُم أَولِياءَ إِنِ استَحَبُّوا الكُفرَ عَلَى الإيمـٰنِ…﴾
“If your father, brother prefers disbelief over faith, then do not take them as friends.”
Severing ties with hypocrites:
﴿فَأَعرِضوا عَنهُم ۖ إِنَّهُم رِجسٌ…﴾
“Turn away from them; they are impure.”
Imam Muhammad bin Ali Sukkabi, may Allah have mercy on him, says:
The Messenger of Allah ﷺ said: Do not speak to the hypocrites, nor sit with them.
Statement of Hazrat Aisha (RA):
“… When you see people who follow ambiguous verses, avoid them.”
Imam Shawkani says:
“Such people are misguided; do not associate with them.”
Conclusion:
◈ Having relations with Mirzais (Qadianis or Lahoris), participating in their gatherings, praying behind their Imamate, or eating and drinking with them is not permissible according to Shariah.
◈ All these actions fall under the category of supporting disbelief and are equivalent to inviting Allah’s punishment.
“If you love your relatives, wealth, and trade more than Allah and His Messenger, then wait until Allah brings His command.”
