Ruling on Using Zakat to Pay the Debt of the Deceased
📖 Source: Fatāwā Arkān al-Islām
The Question:
If a person dies leaving no wealth behind, can his outstanding debts be paid from zakat funds?
Scholarly Statements and Differing Opinions:
Claimed Consensus:
- Imām Ibn ‘Abd al-Barr and Imām Abū ‘Ubayd stated:
“It is a matter of consensus that zakat should not be used to pay off the debt of a deceased person.”
- However, in reality, there is scholarly disagreement on this issue.
Majority View:
- Most scholars say:
“Zakat funds should not be used to pay the debts of the deceased.”
Reasons:
- The deceased has moved to the Hereafter and is no longer subject to worldly shame or humiliation as the living are.
- The Prophet ﷺ did not pay off deceased people’s debts from zakat funds.
- When Allah granted him wealth from conquests, he paid debts from war spoils, not from zakat.
Conclusion from this view:
- Zakat should not be used to settle the debts of the dead.
Another View:
- If the deceased intended to repay the debt when borrowing, Allah will, by His grace, pay it off for him.
- But if he never intended repayment, then he wronged himself and will face the claim on the Day of Judgement.
Preferred (Rājiḥ) View of the Author:
- It is permissible to use zakat funds to pay off the debt of a deceased person.
Balanced / Middle Approach:
- If living people are in greater need (due to poverty, jihad, ransom, etc.), zakat should not be used for the dead’s debt.
- If the living are not in such need, zakat may be used to pay off the debts of those deceased who left no wealth behind.
Summary Table:
| View | Ruling | Reasoning |
|---|---|---|
| Majority | Not allowed | No precedent from Prophet ﷺ; deceased feels no worldly harm |
| Minority | Allowed | Debt is part of “in the cause of Allah” needs |
| Middle Position | Allowed only if living are not in greater need | Balances priorities between living and deceased |
Conclusion:
- The strongest and most balanced opinion is that paying a deceased’s debt from zakat is permissible when living recipients are not in greater need, especially if the deceased left no wealth to settle it.
