Hadith 215

أَنْبَأَنَا مَالِكٌ ، عَنْ زَيْدِ بْنِ أَسْلَمَ ، عَنْ عَطَاءِ بْنِ يَسَارٍ ، أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ رَضِيَ اللَّهُ عَنْهُ بَاعَ سِقَايَةً مِنْ ذَهَبَ أَوْ وَرِقٍ بِأَكْثَرَ مِنْ وَزْنِهَا ، فَقَالَ لَهُ أَبُو الدَّرْدَاءِ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ مِثْلِ هَذَا إِلا مِثْلا بِمِثْلٍ . فَقَالَ مُعَاوِيَةُ : مَا أَرَى بِهَذَا بَأْسًا . فَقَالَ أَبُو الدَّرْدَاءِ : مَنْ يَعْذِرُنِي مِنْ مُعَاوِيَةَ ؟ أُخْبِرُهُ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَيُخْبِرُنِي عَنْ رَأْيِهِ ! لا أُسَاكِنُكَ بِأَرْضٍ أَنْتَ فِيهَا ، ثُمَّ قَدِمَ أَبُو الدَّرْدَاءِ عَلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ فَذَكَرَ ذَلِكَ لَهُ ، فَكَتَبَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ إِلَى مُعَاوِيَةَ : " أَنْ لا تَبِيعَ ذَلِكَ إِلا مِثْلا بِمِثْلٍ وَوَزْنًا بِوَزْنٍ " .
It is narrated from Ata bin Yasar (may Allah have mercy on him) that Sayyiduna Muawiyah bin Abi Sufyan (may Allah be pleased with him) bought a vessel of gold or silver in exchange for more gold or silver than its weight. Sayyiduna Abu Darda (may Allah be pleased with him) said to him: I heard the Messenger of Allah (peace and blessings of Allah be upon him) forbidding such a transaction, except when the weights of both are equal. Muawiyah (may Allah be pleased with him) said: I do not see any harm in this (because it is for extra workmanship). (According to some versions) Sayyiduna Abu Darda (may Allah be pleased with him) said: Who will deal with Muawiyah (may Allah be pleased with him) regarding my matter? I am narrating a hadith and he is giving his own opinion. Then Abu Darda (may Allah be pleased with him) said: I cannot reside in a land where you are. Then Sayyiduna Abu Darda (may Allah be pleased with him) went to Sayyiduna Umar (may Allah be pleased with him) and complained that the hadith was not being acted upon there. So Sayyiduna Umar (may Allah be pleased with him) wrote an order to Sayyiduna Muawiyah (may Allah be pleased with him) stating: "The buying and selling of gold and silver should be weight for weight and like for like (i.e., when both are of the same kind, the weights should be equal and the transaction should be in cash)."
