Book of Divorce
بَابُ مَنْ وَقَّتَ لِلطَّلَاقِ وَقْتًا
on one who sets a time for divorce

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، قَالَ: «مَنْ وَقَّتَ لِلطَّلَاقِ وَقْتًا، فَإِذَا جَاءَ ذَلِكَ الْوَقْتُ وَقَعَ الطَّلَاقُ»
Ibrahim (may Allah have mercy on him) said: "Whoever sets a time for divorce, when that time comes, the divorce will take effect."
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، قَالَ: «إِذَا وَقَّتَ فِي الطَّلَاقِ وَالْعِتَاقِ وَقَعَ، وَإِذَا لَمْ يُوَقِّتْ لَمْ يَقَعْ»
Ibrahim (may Allah have mercy on him) said: "If a specific time is set in divorce and emancipation, it takes effect; if no specific time is set, it does not take effect."
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا عُبَيْدَةُ، عَنِ الشَّعْبِيِّ، مِثْلَهُ
Hazrat Sha'bi (may Allah have mercy on him) said: "If a time is fixed for divorce or emancipation, it takes effect."
حَدَّثَنَا سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ: " إِذَا قَالَ الرَّجُلُ لِامْرَأَتِهِ: أَنْتِ طَالِقٌ إِلَى سَنَةٍ فَهِيَ طَالِقٌ حِينَئِذٍ "
Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) said: "When a man says to his wife: 'You are divorced after one year,' then the divorce will take place immediately."
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يَحْيَى بْنُ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، «أَنَّهُ كَانَ لَا يُؤَجِّلُ فِي الطَّلَاقِ»
Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) did not grant respite in divorce.
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ مَنْصُورٍ، وَيُونُسَ، عَنِ الْحَسَنِ، «أَنَّهُ كَانَ لَا يُؤَجِّلُ فِي الطَّلَاقِ»
Hasan (may Allah have mercy on him) also did not consider granting respite in divorce to be permissible.
