قَوْلُهُ تَعَالَى: {وَإِنْ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ وَقَدْ فَرَضْتُمْ لَهُنَّ فَرِيضَةً فَنِصْفُ مَا فَرَضْتُمْ إِلا أَنْ يَعْفُونَ أَوْ يَعْفُوَ الَّذِي بِيَدِهِ عُقْدَةُ النِّكَاحِ وَأَنْ تَعْفُوا أَقْرَبُ لِلتَّقْوَى}
His saying, Exalted is He: {And if you divorce them before you have touched them and you have already specified for them an obligation, then [give] half of what you specified—unless they forgo the right or the one in whose hand is the marriage contract forgoes it. And to forgo it is nearer to righteousness.}
Sunan Sa'id bin Mansur 391 — His saying, Exalted is He: {And if you
حَدَّثَنَا سَعِيدٌ قَالَ: نَا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنِ الشَّعْبِيِّ، قَالَ: وَاللهِ مَا قَضَى شُرَيْحٌ بِقَضَاءٍ قَطُّ، كَانَ أَحْمَقَ مِنْهُ، حِينَ تَرَكَ قَوْلَهُ الْأَوَّلَ وَأَخَذَ بِهَذَا .
Shu'bi (may Allah have mercy on him) said: "By Allah! Shurayh (may Allah have mercy on him) never made a decision more inappropriate than when he abandoned his first statement and adopted this second opinion."
