بَابُ مَا جَاءَ فِيمَنْ بَدَأَ بِالْيَمِينِ فِي الطَّلَاقِ وَالْعَتَاقِ قَبْلَ الِاسْتِثْنَاءِ
Chapter on those who begin with an oath in divorce and emancipation before making an exception
Sunan Sa'id bin Mansur 2994 — on those who begin with an oath
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، «أَنَّهُ كَانَ يُجِيزُ الثُّنْيَا فِي الطَّلَاقِ، قَدَّمَ الطَّلَاقَ أَوْ أَخَّرَهُ بَعْدَ أَنْ يَصِلَ ذَلِكَ بِمَنْطِقِهِ وَكَلَامِهِ»
Hasan (may Allah have mercy on him) said: "Exception in divorce is permissible, whether the exception is mentioned before or after the divorce, as long as it is connected with the conversation."
