بَابُ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ وَهِيَ حَائِضٌChapter: A man divorces his wife while she is menstruating
Hadith 2726

حَدَّثَنَا هُشَيْمٌ، أنا يُونُسُ، عَنِ الْحَسَنِ، قَالَ: «إِنْ طَلَّقَهَا طَلْقَةً فَهُوَ أَحَقُّ بِرَجْعَتِهَا لَمْ تَعْتَدَّ بِهَا، وَإِنْ طَلَّقَهَا طَلَاقًا بَائِنًا اعْتَدَّتْ بِهَا»
Hasan (may Allah have mercy on him) said: If a revocable divorce is given, then there is the right of return and there is no waiting period (‘iddah); if an irrevocable divorce is given, then the waiting period (‘iddah) will be counted.
