Sunan Sa'id bin Mansur 2669 — What is reported regarding ila'
حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَبِي عَبْدِ اللَّهِ الشَّقَرِيِّ، عَنْ عَامِرٍ، عَنْ مَسْرُوقٍ، " فِي رَجُلٍ كَانَتْ تَحْتَهُ أَمَةٌ فَطَلَّقَهَا تَطْلِيقَتَيْنِ، ثُمَّ غَشِيَهَا سَيِّدُهَا، أَتَحِلُّ لِزَوْجِهَا؟ فَقَالَ: سَمِعْتُ اللَّهَ تَعَالَى يَقُولُ {حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ} [البقرة: 230] وَلَيْسَ هَذَا بِزَوْجٍ "
Hazrat Masruq (may Allah have mercy on him) said that whoever gave his slave woman two divorces and then her master had intercourse with her, she would not be lawful for him because Allah Almighty has said «حَتّٰى تَنْكِحَ زَوْجًا غَيْرَهُ» and this is not a marriage.
