بَابُ مَا جَاءَ فِي طَلَاقِ السَّكْرَانِ وَمَنْ لَمْ يَرَهُ وَمَنْ أَجَازَهُ
Chapter: What is reported regarding the divorce of the intoxicated, the absent, and those who permit it
Sunan Sa'id bin Mansur 2281 — What is reported regarding the divorce
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ «أَنَّهُ كَانَ يُجِيزُ طَلَاقَ السَّكْرَانِ، وَمَا أَتَى مِنْ حَدٍّ فِي سُكْرِهِ أُقِيمَ عَلَيْهِ» .
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: Divorce given in a state of intoxication is valid, and whoever becomes liable for a hadd punishment, the hadd will be established upon him.
