بَابُ مَا جَاءَ فِي الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ فَتَمُوتُ قَبْلَ أَنْ يَدْخُلَ بِهَا أَوْ يُطَلِّقَهَا، هَلْ يَصْلُحُ لَهُ أَنْ يَتَزَوَّجَ أُمَّهَا
Chapter: What is reported regarding a man marrying a woman, then she dies before consummation or he divorces her—can he marry her mother?
Sunan Sa'id bin Mansur 2112 — What is reported regarding a man
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، وَخَالِدٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، فِي الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ فَتَمُوتُ قَبْلَ - أُرَاهُ قَالَ: أَنْ يَدْخُلَ بِهَا - أَيَتَزَوَّجُ أُمَّهَا؟ فَقَالَ: كَانَ شُرَيْحٌ إِذَا أُتِيَ فِي ذَلِكَ يَقُولُ: «ائْتُوا بَنِي شَمْخٍ فَسَلُوهُمْ عَنْ ذَلِكَ»
This issue was presented to Hazrat Shurayh (may Allah have mercy on him): If a man marries a woman, and before consummation he dies, Shurayh said: "Ask Banu Shumakh about this matter."
