بَابٌ فِي الْمُكَاتَبِ يَمُوتُ وَيَتْرُكُ وَرَثَةً وَعَلَيْهِ بَقِيَّةٌ مِنْ مُكَاتَبَتِهِ
Chapter: The mukatab (contracted slave) dies leaving heirs and still owes part of his contract
Sunan Sa'id bin Mansur 1652 — The mukatab (contracted slave) dies
سَعِيدٌ قَالَ: نا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ أُنَيْسِ بْنِ أَبِي يَحْيَى الْأَسْلَمِيِّ، قَالَ: أَرْسَلَنِي رِجَالٌ مِنْ قُرَيْشٍ إِلَى سَعِيدِ بْنِ الْمُسَيِّبِ فِي مُكَاتَبٍ كَانَ بَيْنَهُمْ، فَقَاطَعَهُ بَعْضُهُمْ وَاسْتَمْسَكَ بَعْضٌ، ثُمَّ مَاتَ الْمُكَاتَبُ وَتَرَكَ مَالًا، فَقَالَ لِي سَعِيدٌ: «يَأْخُذَ الَّذِينَ تَمَسَّكُوا بِكِتَابَتِهِ مَا لَهُمْ عَلَيْهِ، ثُمَّ يَقْتَسِمُوا مَا بَقِيَ بِقَدْرِ حِصَصِهِمْ فِي الْمُكَاتَبِ»
Hazrat Saeed bin Musayyib (may Allah have mercy on him) says: "If some of the owners of a mukatab remained upon the contract and some left it, then the mukatab died and left wealth, those who remained upon the contract should take their due, then the remaining wealth should be distributed among the owners according to their share in the mukatab."
