بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِ

Sunan Sa'id bin Mansur 1543 — Can a man bequeath more than a third
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: «إِذَا أَوْصَى الرَّجُلُ بِثُلُثِهِ لِبَنِي فُلَانٍ فَهُوَ لَهُمْ، الذَّكَرُ وَالْأُنْثَى سَوَاءٌ فِيهِ»
Hasan al-Basri (may Allah have mercy on him) said: "If a person makes a bequest of one third of his wealth for the Banu so-and-so, then it will be equal for all of them, men and women being equal."
