بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِ

Sunan Sa'id bin Mansur 1534 — Can a man bequeath more than a third
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا جُوَيْبِرٌ، عَنِ الضَّحَّاكِ أَنَّهُ كَانَ يَقُولُ: «لَوْ كُنْتُ وَالِيًا فَأُوتَيْتُ بِمَنْ أَوْصَى لِغَيْرِ ذِي قَرَابَتِهِ رَدَدْتُ ذَلِكَ وَلَوْ بُنِيَتْ بِهِ الدُّورُ أَوِ اتُّخِذَتْ بِهِ الْأَمْوَالُ»
Dhahhak (may Allah have mercy on him) said: "If I were a ruler and someone made a bequest for a non-relative, I would reject that bequest, even if palaces were built or wealth was obtained from it."
