بَابُ الرَّجُلِ يُعْتِقُ فَيَمُوتُ وَيَتْرُكُ وَرَثَةً ثُمَّ يَمُوتُ الْمُعْتَقُ
Chapter on a man who frees a slave, then dies and leaves heirs, then the freed slave dies
Sunan Sa'id bin Mansur 1444 — on a man who frees a slave, then dies
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَشْعَثُ بْنُ سَوَّارٍ، عَنِ الشَّعْبِيِّ، أَنَّ عُمَرَ، وَعَلِيًّا، وَابْنَ مَسْعُودٍ، وَعَبْدَ اللَّهِ، وَزَيْدًا «كَانُوا يَجْعَلُونَ الْوَلَاءَ لِلْكُبْرِ»
Sayyiduna Umar, Sayyiduna Ali, Sayyiduna Abdullah bin Mas'ud, Sayyiduna Abdullah, and Sayyiduna Zaid (may Allah be pleased with them) used to appoint guardianship for the eldest.
