Chapter on inheritance of a freed slave
Sunan Sa'id bin Mansur 1405 — on inheritance of a freed slave
سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ أَبِي بَكْرِ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي مَرْيَمَ، عَنْ رَاشِدِ بْنِ سَعْدٍ، وَضَمْرَةَ بْنِ حَبِيبٍ، قَالَا: «وَلَاءُ السَّائِبَةِ لِمَنْ أَعْتَقَهُ إِنَّمَا سَيَّبَ رَقَبَتَهُ مِنَ الرِّقِّ وَلَمْ يُسَيِّبْهَا مِنَ الْوَلَاءِ»
Rashid bin Sa'id (may Allah have mercy on him) and Dumrah bin Habib (may Allah have mercy on him) said: "The right of guardianship (wilayah) of a freed slave belongs to the one who set him free; he has only freed him from slavery, not from guardianship."
