Chapter on inheritance of a freed slave
Sunan Sa'id bin Mansur 1402 — on inheritance of a freed slave
سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، فِي رَجُلٍ أَعْتَقَ غُلَامَهُ سَائِبَةً فَمَاتَ، فَجَاءَ بِمِيرَاثِهِ إِلَى ابْنِ مَسْعُودٍ فَسَأَلَهُ عَنْهُ، فَقَالَ: " أَنْتَ أَحَقُّ بِهِ فَرَدَّ عَلَيْهِ فَقَالَ لَهُ: إِنْ شِئْتَ فَاجْعَلْهُ فِي مِثْلِ السَّبِيلِ الَّذِي كُنْتَ جَعَلْتَهُ فِيهِ "
Ibrahim Nakha'i (may Allah have mercy on him) says: "If a person frees his slave and the slave dies, his inheritance will return to the one who freed him, and he may spend it in the same cause for which he had freed him, if he wishes."
