قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي الْقَدِيمِ: فِيهَا قَوْلَانِ أَحَدُهُمَا تَحْلِفُ وَيَكُونُ لَهَا الْخِيَارُ وَهُوَ أَحَبُّ إِلَيْنَا، وَالْقَوْلُ الْآخَرُ لَا خِيَارَ لَهَا.
Imam al-Shafi'i (may Allah have mercy on him) said in his old (position): "There are two views concerning her (this woman): one of them is that she takes an oath and has the choice (to annul the marriage), and this is dearer to us; and the other view is that she has no choice."
