باب: : لا تجوز هبة المكاتب حتى يبتدئها بإذن السيد.

أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ الْفَقِيهُ، ثنا الْحَسَنُ بْنُ سُفْيَانَ، ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، عَنِ ابْنِ الْمُبَارَكِ ح قَالَ: وَأنبأ أَبُو الْوَلِيدِ، ثنا إِبْرَاهِيمُ بْنُ أَبِي طَالِبٍ، ثنا الْحَسَنُ بْنُ عِيسَى، عَنِ ابْنِ الْمُبَارَكِ، عَنْ صَالِحِ بْنِ خَوَّاتٍ، عَنْ عَبْدِ اللهِ بْنِ أَبِي بَكْرٍ، أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ كَتَبَ إِلِيَّ: " أَنَّ الْمُكَاتَبَ، لَا يَجُوزُ لَهُ وَصِيَّةٌ، وَلَا هِبَةٌ إِلَّا بِإِذْنِ مَوْلَاهُ ".
Abdullah bin Abi Bakr (may Allah have mercy on him) says that Umar bin Abd al-Aziz (may Allah have mercy on him) wrote to me that for a mukatab, a bequest and a gift are permissible only with the permission of his master.
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْوَلِيدِ، ثنا الْحَسَنُ بْنُ سُفْيَانَ، ثنا أَبُو بَكْرٍ، ثنا ابْنُ أَبِي عَدِيٍّ، عَنْ أَشْعَثَ، عَنِ الْحَسَنِ قَالَ: " الْمُكَاتَبُ لَا يَعْتِقُ، وَلَا يَهَبُ إِلَّا بِإِذْنِ مَوْلَاهُ ". قَالَ مُحَمَّدُ بْنُ أَبِي عَدِيٍّ فِي هَذَا الْحَدِيثِ: كَانُوا يَقُولُونَ: " الْمُكَاتَبُ لَا يَعْتِقُ وَلَا يَهَبُ إِلَّا بِإِذْنِ مَوْلَاهُ ".
Al-Hasan (may Allah have mercy on him) said: The mukatab may free (a slave) and give a gift only with the permission of his master. In the hadith of Muhammad bin Abi Adi (may Allah have mercy on him) it is: The mukatab may free (a slave) and give a gift only with the permission of his master.
