Book of Oaths
باب: من حلف: ليضربن عبده مائة سوط، فجمعها فضربه بها، لم يحنث استدلالا بقوله عز وجل وخذ بيدك ضغثا فاضرب به ولا تحنث
One who swears he will strike his slave a hundred lashes, then gathers them and strikes him with them at once, does not break his oath, based on the words of Allah the Mighty and Majestic: And take in your hand a bunch of twigs and strike with it and do not break your oath

بِقَوْلِهِ عَزَّ وَجَلَّ {وَخُذْ بِيَدِكَ ضِغْثًا فَاضْرِبْ بِهِ وَلَا تَحْنَثْ} [ص: 44].
(It is argued) from this saying of Allah, the Mighty and Majestic: "And take in your hand a bundle of twigs, and strike with it, and do not break your oath." [Surah Sad: 44]
وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أنبأ مُحَمَّدُ بْنُ بَكْرٍ، ثنا أَبُو دَاوُدَ، ثنا أَحْمَدُ بْنُ سَعِيدٍ الْهَمَذَانِيُّ، ثنا ابْنُ وَهْبٍ، أَخْبَرَنِي يُونُسُ، عَنِ ابْنِ شِهَابٍ، أَخْبَرَنِي أَبُو أُمَامَةَ بْنُ سَهْلِ بْنِ حُنَيْفٍ أَنَّهُ أَخْبَرَهُ بَعْضُ أَصْحَابِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مِنَ الْأَنْصَارِ أَنَّهُ اشْتَكَى رَجُلٌ مِنْهُمْ حَتَّى أُضْنِيَ، فَعَادَ جِلْدُهُ عَلَى عَظْمٍ، فَدَخَلَتْ عَلَيْهِ جَارِيَةٌ لِبَعْضِهِمْ فَهَشَّ لَهَا فَوَقَعَ عَلَيْهَا، ثُمَّ ذَكَرَ قِصَّتَهُ قَالَ: " فَأَمَرَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ يَأْخُذُوا لَهُ مِائَةَ شِمْرَاخٍ، فَيَضْرِبُوهُ بِهَا ضَرْبَةً وَاحِدَةً ".
Abu Umamah bin Sahl bin Hunayf (may Allah be pleased with him) narrated from some of the Ansari Companions (may Allah be pleased with them) of the Prophet (peace and blessings be upon him) that a man was suffering from illness until he wasted away, and his skin clung to his bones. A slave girl came in to him; he became excited by her and had intercourse with her. Then he mentioned his incident to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) said: "Gather a hundred twigs for him and strike him with them a single time."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا أَحْمَدُ بْنُ عَبْدِ الْجَبَّارِ، ثنا وَكِيعٌ، عَنْ إِسْمَاعِيلَ بْنِ عَبْدِ الْمَلِكِ، عَنْ عَطَاءٍ قَالَ: " جَاءَهُ رَجُلٌ وَأَنَا عِنْدَهُ، فَقَالَ: " إِنِّي حَلَفْتُ أَنْ لَا أَكْسُوَ أَهْلِي حَتَّى أَقِفَ بِعَرَفَةَ وَذَاكَ فِي غَيْرِ أَيَّامِ الْحَجِّ فَقَالَ عَطَاءٌ: " اذْهَبْ فَقِفْ، وَاكْسُ أَهْلَكَ "، فَقِيلَ لِعَطَاءٍ: " إِنَّمَا نَوَى الْحَجَّ "، فَقَالَ عَطَاءٌ: أَرَأَيْتَ أَيُّوبَ عَلَيْهِ السَّلَامُ حِينَ حَلَفَ لَيَضْرِبَنَّ أَهْلَهُ، حَلَفَ لَيَضْرِبَنَّهَا بِضِغْثٍ؟ إِنَّمَا الْقُرْآنُ أَمْثَالٌ وَعِبَرٌ ".
Isma'il bin Abd al-Malik (may Allah have mercy on him) narrates from Ata (may Allah have mercy on him) that a man came to him while I was present, and said: I have sworn that I will not clothe my family until the standing at Arafah, but these were not the days of Hajj. Ata (may Allah have mercy on him) said: Go and stand (at Arafah), and clothe your family. It was said to Ata (may Allah have mercy on him): He intended the Hajj. Ata (may Allah have mercy on him) said: Do you think that when Ayyub (peace be upon him) swore that he would beat his family, he swore that he would beat (them) with a bundle (of twigs)? The Qur'an is only examples and lessons.
