It is narrated from Mujahid (may Allah have mercy on him) that Safwan bin Umayyah (may Allah be pleased with him) was one of the Tulaqa' (those set free on the day of the Conquest of Makkah). He came to the Prophet (peace and blessings be upon him), made his mount kneel and placed his cloak on it. Then he went aside to relieve himself, and a man came and stole his cloak. He caught him and brought him to the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) ordered that his hand be cut. He said: O Messenger of Allah! Will you cut his hand for my cloak? I give it to him as a gift. He (peace and blessings be upon him) said: "Why did you not do so before you brought him to me?"

Sayyidah Aishah (may Allah be pleased with her) said that Quraysh were troubled by (the matter of) a woman who had stolen in the time of the Prophet (peace and blessings be upon him), during the campaign of the Conquest (of Makkah). He then mentioned the meaning of al-Layth's hadith and added these words: Then that woman who had stolen was brought, and her hand was cut.
Yunus said that Sayyidah Aishah (may Allah be pleased with her) said: After that she repented well and got married. She used to come afterwards, and I would present her need to the Prophet (peace and blessings be upon him). Muslim narrated it in the Sahih from Abu Tahir, and al-Bukhari narrated it from Ibn Abi Uways, from Ibn Wahb.
Our scholars said: If the cutting could be dropped from the thief by the owner gifting the stolen property, then intercession would have been all the more possible.
