أَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ، وَالْفَقِيهُ أَبُو الْحَسَنِ بْنُ أَبِي الْمَعْرُوفِ، قَالَا: أنبأ أَبُو عَمْرِو بْنُ نُجَيْدٍ السُّلَمِيُّ، أنبأ أَبُو مُسْلِمٍ، ثنا أَبُو عَاصِمٍ، عَنِ ابْنِ أَبِي ذِئْبٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَالِمٍ، عَنِ ابْنِ عُمَرَ أَنَّ عُمَرَ رَضِيَ اللهُ عَنْهُ " كَانَ يَضْرِبُ فِي التَّعْرِيضِ الْحَدَّ ".
Sayyiduna Ibn Umar (may Allah be pleased with them both) said that Sayyiduna Umar (may Allah be pleased with him) used to apply the prescribed punishment even for ta'rid (accusing by insinuation).
وَأَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ، أنبأ أَبُو بَكْرِ بْنُ جَعْفَرٍ، ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ، ثنا ابْنُ بُكَيْرٍ، ثنا مَالِكٌ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ أَبِي الرِّجَالِ، عَنْ أُمِّهِ عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ، أَنَّ رَجُلَيْنِ اسْتَبَّا فِي زَمَنِ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ، فَقَالَ أَحَدُهُمَا لِلْآخَرِ: مَا أَبِي بِزَانٍ، وَلَا أُمِّي بِزَانِيَةٍ، فَاسْتَشَارَ فِي ذَلِكَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ، فَقَالَ قَائِلٌ: مَدَحَ أَبَاهُ وَأُمَّهُ، وَقَالَ آخَرُونَ: كَانَ لِأَبِيهِ وَأُمِّهِ مَدْحٌ، سِوَى هَذَا نَرَى أَنْ تَجْلِدَهُ الْحَدَّ، " فَجَلَدَهُ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ الْحَدَّ ثَمَانِينَ ".
Amrah bint Abd al-Rahman said: In the time of Sayyiduna Umar (may Allah be pleased with him) two men quarrelled, and one said to the other: "My father is not an adulterer, nor is my mother." Sayyiduna Umar (may Allah be pleased with him) sought counsel about it; one said that he had praised his parents. Others said: "Praise of parents could also be made with other words. Our view is that he should be flogged." So Sayyiduna Umar (may Allah be pleased with him) gave him eighty lashes.
