قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {وَالَّذِينَ يَرْمُونَ الْمُحْصَنَاتِ ثُمَّ لَمْ يَأْتُوا بِأَرْبَعَةِ شُهَدَاءَ فَاجْلِدُوهُمْ ثَمَانِينَ جَلْدَةً وَلَا تَقْبَلُوا لَهُمْ شَهَادَةً أَبَدًا، وَأُولَئِكَ هُمُ الْفَاسِقُونَ} [النور: 4].
Allah, Exalted be His praise, says: "And those who accuse chaste women and then do not bring four witnesses, flog them eighty lashes and never accept their testimony, and it is they who are the defiantly disobedient." [Surah al-Nur: 4]
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، وَأَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي، قَالَا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا أَحْمَدُ بْنُ عَبْدِ الْجَبَّارِ، ثنا يُونُسُ بْنُ بُكَيْرٍ، عَنِ ابْنِ إِسْحَاقَ، قَالَ: حَدَّثَنِي عَبْدُ اللهِ بْنُ أَبِي بَكْرِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ بْنِ أَسْعَدَ بْنِ زُرَارَةَ، عَنْ عَائِشَةَ رَضِيَ اللهُ عَنْهَا أَنَّهَا قَالَتْ: لَمَّا تَلَا رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الْقِصَّةَ الَّتِي نَزَلَ بِهَا عُذْرِي عَلَى النَّاسِ، نَزَلَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَمَرَ بِرَجُلَيْنِ وَامْرَأَةٍ مِمَّنْ كَانَ بَاءَ بِالْفَاحِشَةِ فِي عَائِشَةَ فَجُلِدُوا الْحَدَّ، قَالَ: وَكَانَ رَمَاهَا عَبْدُ اللهِ بْنُ أُبَيٍّ، وَمِسْطَحُ بْنُ أُثَاثَةَ، وَحَسَّانُ بْنُ ثَابِتٍ، وَحَمْنَةُ بِنْتُ جَحْشٍ أُخْتُ زَيْنَبَ بِنْتِ جَحْشٍ، رَمَوْهَا بِصَفْوَانَ بْنِ الْمُعَطَّلِ السُّلَمِيِّ وَكَذَلِكَ رَوَاهُ مُحَمَّدُ بْنُ أَبِي عَدِيٍّ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ.
Sayyidah Aishah (may Allah be pleased with her) said: When Allah Almighty revealed my innocence in the incident of the Ifk (slander), the Prophet (peace and blessings be upon him) ordered concerning two men and a woman that the prescribed punishment for slander (qadhf) be applied to them. Those who had made the accusation were: Abdullah bin Ubayy, Mistah bin Uthathah (may Allah be pleased with him), Hassan bin Thabit (may Allah be pleased with him), and Hamnah bint Jahsh (may Allah be pleased with her), the sister of Zaynab bint Jahsh (may Allah be pleased with her); they had accused Sayyidah Aishah (may Allah be pleased with her) with Safwan bin al-Mu'attal al-Sulami (may Allah be pleased with him).
وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ، ثنا أَبُو دَاوُدَ، ثنا النُّفَيْلِيُّ، ثنا مُحَمَّدُ بْنُ سَلَمَةَ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ، بِهَذَا الْحَدِيثِ، لَمْ يَذْكُرْ عَائِشَةَ، قَالَ: فَأَمَرَ بِرَجُلَيْنِ وَامْرَأَةٍ مِمَّنْ تَكَلَّمَ بِالْفَاحِشَةِ فَضُرِبُوا حَدَّهُمْ: حَسَّانِ بْنِ ثَابِتٍ، وَمِسْطَحِ بْنِ أُثَاثَةَ قَالَ أَبُو دَاوُدَ: قَالَ النُّفَيْلِيُّ: وَيَقُولُونَ الْمَرْأَةُ حَمْنَةُ بِنْتُ جَحْشٍ.
This has passed before it.
أَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ، أنبأ عَلِيُّ بْنُ الْفَضْلِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ، ثنا يُوسُفُ بْنُ يَعْقُوبَ الْقَاضِي، ثنا أَبُو الرَّبِيعِ، ثنا فُلَيْحُ بْنُ سُلَيْمَانَ، قَالَ: وَسَمِعْتُ نَاسًا، مِنْ أَهْلِ الْعِلْمِ يَقُولُونَ: " إِنَّ أَصْحَابَ الْإِفْكِ جُلِدُوا الْحَدَّ، وَلَا نَعْلَمُ ذَلِكَ فَشَا.
Fulayh bin Sulayman said: I heard people of knowledge say that the people of the Ifk were flogged as the prescribed punishment, and we do not know that this became widely known.
وَأَخْبَرَنَا أَبُو الْحَسَنِ بْنُ عَبْدَانَ، أنبأ أَحْمَدُ بْنُ عُبَيْدٍ، ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ، ثنا عَلِيُّ بْنُ الْمَدِينِيِّ، ثنا هِشَامُ بْنُ يُوسُفَ، ثنا الْقَاسِمُ ابْنُ أَخِي خَلَّادٍ، عَنْ خَلَّادِ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَنَّهُ سَمِعَ ابْنَ عَبَّاسٍ، يَقُولُ: " بَيْنَا رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَخْطُبُ النَّاسَ أَتَاهُ رَجُلٌ مِنْ بَنِي لَيْثِ بْنِ بَكْرٍ، فَذَكَرَ الْحَدِيثَ فِي إِقْرَارِهِ بِالزِّنَا بِامْرَأَةٍ، وَإِنْكَارِهَا، وَجَلْدِهِ مِائَةً، وَلَمْ يَكُنْ تَزَوَّجَ قَالَ: فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " مَنْ شُهُودُكَ أَنَّكَ خَبَثْتَ بِهَا فَإِنَّهَا تُنْكِرُ؟ فَإِنْ كَانَ لَكَ شُهَدَاءُ جَلَدْتُهَا، وَإِلَّا جَلَدْتُكَ حَدَّ الْفِرْيَةِ "، فَقَالَ: يَا رَسُولَ اللهِ وَاللهِ مَا لِي شُهَدَاءُ، فَأَمَرَ بِهِ فَجُلِدَ حَدَّ الْفِرْيَةِ ثَمَانِينَ.
Ibn Abbas (may Allah be pleased with them both) said: The Messenger of Allah (peace and blessings be upon him) was delivering a sermon when a man from Banu Layth bin Bakr came. Then he mentioned the long hadith of his confession and the woman's denial. He was unmarried, so he (peace and blessings be upon him) gave him a hundred lashes and then said: "Bring witnesses against the one you have accused." He had no witnesses, so he (peace and blessings be upon him) applied the prescribed punishment for slander to him.
أَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ، أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ، ثنا ابْنُ قُتَيْبَةَ، ثنا هِشَامُ بْنُ عَمَّارٍ، ثنا مُسْلِمُ بْنُ خَالِدٍ الزَّنْجِيُّ، ثنا عَبَّادُ بْنُ إِسْحَاقَ، عَنْ أَبِي حَازِمٍ، عَنْ سَهْلِ بْنِ سَعْدٍ، قَالَ: جَاءَ رَجُلٌ إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: إِنَّهُ زَنَى بِفُلَانَةَ، امْرَأَةٌ سَمَّاهَا، فَبَعَثَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ إِلَيْهَا فَأَنْكَرَتْ " فَرَجَمَهُ وَتَرَكَهَا ".
Sahl bin Sa'd (may Allah be pleased with him) said: A man came to the Prophet (peace and blessings be upon him) and said that he had committed adultery with a certain woman. So the Prophet (peace and blessings be upon him) had the woman asked, and she denied it; so he (peace and blessings be upon him) had him stoned and left the woman.
أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ، أنبأ عَبْدُ اللهِ بْنُ جَعْفَرٍ، ثنا يَعْقُوبُ بْنُ سُفْيَانَ، ثنا أَبُو نُعَيْمٍ، ثنا سُفْيَانُ، عَنْ سَلَمَةَ بْنِ الْمَجْنُونِ الْحَنَفِيِّ، قَالَ: قُلْتُ لِرَجُلٍ: يَا فَاعِلُ بِأُمِّهِ، فَقَدَّمَنِي إِلَى أَبِي هُرَيْرَةَ " فَضَرَبَنِي الْحَدَّ " قَالَ يَعْقُوبُ: سَلَمَةُ يُكَنَّى بِأَبِي عَيْثَمَةَ، مِنْ بَنِي شَيْبَانَ، وَقَالَ شُعْبَةُ: عَنْ أَبِي مَيْمُونَةَ قَالَ: قَدِمْتُ الْمَدِينَةَ.
Salamah bin al-Majnun al-Hanafi said: I said to a man, "O you who violate his own mother!" so he took me to Sayyiduna Abu Hurayrah (may Allah be pleased with him), and he applied the prescribed punishment to me.
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، قَالَ: سَمِعْتُ أَبَا الْعَبَّاسِ مُحَمَّدَ بْنَ يَعْقُوبَ يَقُولُ: سَمِعْتُ الْعَبَّاسَ بْنَ مُحَمَّدٍ، يَقُولُ: ثنا عُثْمَانُ بْنُ عُمَرَ بْنِ فَارِسٍ، أنبأ شُعْبَةُ، عَنْ أَبِي مَيْمُونَةَ، قَالَ: قَدِمْتُ الْمَدِينَةَ فَنَزَلْتُ عَنْ رَاحِلَتِي، فَعَقَلْتُهَا فَدَخَلْتُ الْمَسْجِدَ، فَجَاءَ رَجُلٌ فَحَلَّ عِقَالَهَا، فَقُلْتُ لَهُ: يَا فَاعِلُ بِأُمِّهِ، قَالَ: فَقَدَّمَنِي إِلَى أَبِي هُرَيْرَةَ" فَضَرَبَنِي ثَمَانِينَ سَوْطًا"، قَالَ: فَأَنْشَأْتُ أَقُولُ:.
Abu Maymunah said: I came to Madinah, tied up my mount and entered the mosque. A man came and began to untie my mount, so I said to him: "O you who commit indecency with his own mother!" So Sayyiduna Abu Hurayrah (may Allah be pleased with him) gave me eighty lashes, and I composed this verse: "If only you could have seen me, today I was made to stand and given eighty lashes, but I am one who is patient."
أَخْبَرَنَا أَبُو الْحَسَنِ الرَّفَّاءُ، أنبأ عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ، ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ، ثنا ابْنُ أَبِي أُوَيْسٍ، ثنا ابْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ: " مَنْ قَالَ لِلرَّجُلِ: يَا لُوطِيُّ، جُلِدَ الْحَدَّ ".
Abu al-Zinad (may Allah have mercy on him) narrates from the jurists of Madinah that whoever says to someone, "O Luti (sodomite)!", will be given the lashes of the prescribed punishment for slander.
