باب: لا يقام حد الجلد على الحبلى ولا على مريض دنف، ولا في يوم حره شديد أو برده مفرط، ولا في أسباب التلف

أَخْبَرَنَا أَبُو الْقَاسِمِ عَبْدُ الْخَالِقِ بْنُ عَلِيِّ بْنِ عَبْدِ الْخَالِقِ الْمُؤَذِّنُ، أنبأ أَبُو بَكْرٍ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ خَنْبٍ الْبَغْدَادِيُّ بِبُخَارَا، ثنا الْحَسَنُ بْنُ سَلَّامٍ السَّوَّاقُ، ثنا ⦗٣٩٩⦘ عُبَيْدُ اللهِ بْنُ مُوسَى، أنبأ إِسْرَائِيلُ، عَنِ السُّدِّيِّ، عَنْ سَعْدِ بْنِ عُبَيْدَةَ، عَنْ أَبِي عَبْدِ الرَّحْمَنِ السُّلَمِيِّ، قَالَ: سَمِعْتُ عَلِيًّا، رَضِيَ اللهُ عَنْهُ، وَهُوَ يَخْطُبُ عَلَى الْمِنْبَرِ، فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ: أَيُّهَا النَّاسُ أَيُّمَا عَبْدٍ أَوْ أَمَةٍ زَنَى فَأَقِيمُوا عَلَيْهِ الْحَدَّ، وَإِنْ كَانَ قَدْ أُحْصِنَ فَاجْلِدُوهُ، فَإِنَّ خَادِمًا لِرَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ زَنَتْ فَأَرْسَلَنِي إِلَيْهَا لِأَضْرِبَهَا فَوَجَدْتُهَا حَدِيثَةَ عَهْدٍ بِنِفَاسِهَا، وَخَشِيتُ إِنْ أَنَا ضَرَبْتُهَا أَنْ أَقْتُلَهَا، فَرَدَدْتُ عَنْهَا حَتَّى تُمَاثِلَ وَتَشْتَدَّ، قَالَ: " أَحْسَنْتَ " أَخْرَجَهُ مُسْلِمٌ فِي الصَّحِيحِ مِنْ حَدِيثِ إِسْرَائِيلَ.
Abu Abd al-Rahman al-Sulami (may Allah have mercy on him) said: I heard Sayyiduna Ali (may Allah be pleased with him) delivering a sermon. After praising and glorifying Allah, he said: O people! Whichever male or female slave commits adultery, apply the prescribed punishment to them; if he is married, flog him. A maidservant of the Prophet (peace and blessings be upon him) had committed adultery, and he (peace and blessings be upon him) sent me to apply the punishment. I found her in the state of postnatal bleeding, and I feared that if I struck her she would die. So I left her at that time, and when she recovered I struck her. The Prophet (peace and blessings be upon him) said: "You did well."
أَخْبَرَنَا أَبُو مُحَمَّدٍ عَبْدُ اللهِ بْنُ يُوسُفَ الْأَصْبَهَانِيُّ، فِيمَا قَرَأْنَا عَلَيْهِ مِنْ أَصْلِهِ، أنبأ أَبُو سَعِيدِ بْنُ الْأَعْرَابِيِّ، ثنا الْحَسَنُ بْنُ مُحَمَّدٍ الزَّعْفَرَانِيُّ، ثنا يَزِيدُ بْنُ هَارُونَ، أنبأ الثَّوْرِيُّ، عَنْ عَبْدِ الْأَعْلَى الثَّعْلَبِيِّ، عَنْ أَبِي جَمِيلَةَ، عَنْ عَلِيٍّ رَضِيَ اللهُ عَنْهُ، أَنَّ جَارِيَةً لِلنَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ نُفِسَتْ مِنَ الزِّنَا، فَأَرْسَلَنِي النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ أُقِيمَ عَلَيْهَا الْحَدَّ، فَوَجَدْتُهَا فِي الدِّمَاءِ لَمْ تَجِفَّ عَنْهَا، فَرَجَعْتُ إِلَى النَبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرْتُهُ فَقَالَ: " إِذَا جَفَّ الدَّمُ عَنْهَا فَاجْلِدْهَا الْحَدَّ " وَقَالَ: " أَقِيمُوا الْحُدُودَ عَلَى مَا مَلَكَتْ أَيْمَانُكُمْ ".
Sayyiduna Ali (may Allah be pleased with him) said that a slave girl of the Prophet (peace and blessings be upon him) gave birth as a result of adultery and was in postnatal bleeding, and he (peace and blessings be upon him) sent me to apply the prescribed punishment to her. I found her in the state of postnatal bleeding, so I came and told the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) said: "When she is free of the postnatal bleeding, then apply the punishment." And he said: "Establish the prescribed punishments upon your slaves as well."
