أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أَنْبَأَ أَبُو بَكْرِ بْنُ دَاسَةَ، ثَنَا أَبُو دَاوُدَ، ثَنَا الْحَسَنُ بْنُ عَلِيِّ بْنِ رَاشِدٍ، أَنْبَأَ هُشَيْمٌ، عَنْ أَبِي حَيَّانَ التَّيْمِيِّ، ثَنَا عَبَايَةُ بْنُ رِفَاعَةَ، عَنْ رَافِعِ بْنِ خَدِيجٍ، قَالَ: أَصْبَحَ رَجُلٌ مِنَ الْأَنْصَارِ مَقْتُولًا بِخَيْبَرَ، فَانْطَلَقَ أَوْلِيَاؤُهُ إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَذَكَرُوا ذَلِكَ لَهُ، فَقَالَ: " أَلَكُمْ شَاهِدَانِ يَشْهَدَانِ عَلَى قَتْلِ صَاحِبِكُمْ؟ " قَالُوا: ⦗٢٣٢⦘ يَا رَسُولَ اللهِ لَمْ يَكُنْ ثَمَّ أَحَدٌ مِنَ الْمُسْلِمِينَ، وَإِنَّمَا هُمْ يَهُوَدُ، وَقَدْ يَجْتَرِئُونَ عَلَى أَعْظَمَ مِنْ هَذَا، وَذَكَرَ الْحَدِيثَ.
Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) said: A man of the Ansar was found killed in Khaybar. His guardians came to the Prophet (peace and blessings be upon him) and related the whole incident. The Prophet (peace and blessings be upon him) said: "Do you have two witnesses who will testify to the killing of your companion?" They said: "O Messenger of Allah, there was no Muslim there; they are only Jews, and they dare to commit even greater sins than this." And he mentioned the complete hadith.
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أَنْبَأَ أَبُو الْوَلِيدِ، ثَنَا مُحَمَّدُ بْنُ هَارُونَ، ثَنَا عُثْمَانُ بْنُ سَعِيدٍ، ثَنَا أَحْمَدُ بْنُ يُونُسَ، ثَنَا أَبُو شِهَابٍ، عَنِ الْأَعْمَشِ، عَنْ تَمِيمِ بْنِ سَلَمَةَ، عَنْ شُرَيْحٍ، قَالَ: شَهِدَ عِنْدَ شُرَيْحٍ رَجُلَانِ فَقَالَا: نَشْهَدُ أَنَّ هَذَا لَهَزَهُ بِمِرْفَقِهِ فِي حَلْقِهِ فَمَاتَ، فَقَالَ: أَتَشْهَدُونَ أَنَّهُ قَتَلَهُ؟ قَالَ الْأَعْمَشُ: فَلَمْ يُجِزْهُ. قَالَ الشَّيْخُ أَبُو الْوَلِيدِ: قَالَ أَصْحَابُنَا: قَدْ يَكُونُ الضَّرْبُ وَلَا يَمُوتُ مِنْهُ، فَلَمَّا لَمْ يَقُولَا: قَتَلَهُ، لَمْ يَحْكُمْ بِهِ.
Shurayh (may Allah have mercy on him) said that two men testified before him, saying: "We testify that this man struck him on his throat and he died." He asked: "Do you testify that he killed him?" Shaykh Abu al-Walid (may Allah have mercy on him) said: They testified to the striking; they did not say that he killed him, so no ruling was passed against him.
