Blood money for the penis and the testicles

أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ، وَأَبُو نَصْرِ بْنُ قَتَادَةَ، قَالَا: أنبأ أَبُو عَمْرِو بْنُ مَطَرٍ، ثنا أَحْمَدُ بْنُ الْحَسَنِ بْنِ عَبْدِ الْجَبَّارِ، ثنا الْحَكَمُ بْنُ مُوسَى، ثنا يَحْيَى بْنُ حَمْزَةَ، عَنْ سُلَيْمَانَ بْنِ دَاوُدَ، حَدَّثَنِي الزُّهْرِيُّ، عَنْ أَبِي بَكْرِ بْنُ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: كَتَبَ إِلَى أَهْلِ الْيَمَنِ بِكِتَابٍ فِيهِ: " وَفِي الْبَيْضَتَيْنِ الدِّيَةُ، وَفِي الذَّكَرِ الدِّيَةُ ".
Abu Bakr bin Muhammad bin Amr bin Hazm (may Allah have mercy on him) said: In the letter that the Prophet (peace and blessings be upon him) wrote to the people of Yemen, it also said: "For the testicles and for the penis there is blood money as well."
أَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ، أنبأ أَبُو الْفَضْلِ بْنُ خَمِيرَوَيْهِ، أنبأ أَحْمَدُ بْنُ نَجْدَةَ، ثنا سَعِيدُ بْنُ مَنْصُورٍ، أنبأ أَبُو عَوَانَةَ، عَنْ أَبِي إِسْحَاقَ، عَنْ عَاصِمِ بْنِ ضَمْرَةَ، عَنْ عَلِيٍّ، رَضِيَ اللهُ عَنْهُ، أَنَّهُ قَالَ: وَفِي الذَّكَرِ الدِّيَةُ، وَفِي إِحْدَى الْبَيْضَتَيْنِ النِّصْفُ وَرُوِي مِنْ وَجْهٍ آخَرَ عَنْ عَاصِمٍ، عَنْ عَلِيٍّ رَضِيَ اللهُ عَنْهُ، أَنَّهُ قَالَ: فِي الْحَشَفَةِ الدِّيَةُ.
Sayyiduna Ali (may Allah be pleased with him) said: For the penis there is the full blood money, for one testicle half, and for the glans the full blood money.
أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، وَأَبُو بَكْرِ بْنُ الْحَسَنِ، وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، قَالُوا: ثنا أَبُو الْعَبَّاسِ، هُوَ الْأَصَمُّ، ثنا بَحْرُ بْنُ نَصْرٍ، ثنا ابْنُ وَهْبٍ، أَخْبَرَنِي يُونُسُ، عَنِ ابْنِ شِهَابٍ، أَنَّ سَعِيدَ بْنَ الْمُسَيِّبِ، أَخْبَرَهُ، أَنَّ السُّنَّةَ مَضَتْ فِي الْعَقْلِ بِأَنَّ فِي الذَّكَرِ الدِّيَةَ، وَفِي الْأُنْثَيَيْنِ الدِّيَةَ،.
Sa'id bin al-Musayyib (may Allah have mercy on him) said: The Sunnah that has been established regarding blood money is that for the penis there is the full blood money, and for both testicles the full blood money.
قَالَ: وَحَدَّثَنَا ابْنُ وَهْبٍ، حَدَّثَنِي عِيَاضُ بْنُ عَبْدِ اللهِ الْفِهْرِيُّ، أَنَّهُ سَمِعَ زَيْدَ بْنَ أَسْلَمَ، يَقُولُ: مَضَتِ السُّنَّةُ بِأَنَّ فِي الذَّكَرِ الدِّيَةَ، وَفِي الْأُنْثَيَيْنِ الدِّيَةَ.
The previous narration is also reported from Zayd bin Aslam (may Allah have mercy on him).
أَخْبَرَنَا عُمَرُ بْنُ عَبْدِ الْعَزِيزِ بْنِ قَتَادَةَ الْأَنْصَارِيُّ، أنبأ أَبُو الْحَسَنِ عَلِيُّ بْنُ الْفَضْلِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ، أنبأ أَبُو شُعَيْبٍ الْحَرَّانِيُّ، ثنا عَلِيُّ بْنُ الْمَدِينِيِّ، ثنا يَزِيدُ بْنُ هَارُونَ، عَنِ الْحَجَّاجِ، عَنْ مَكْحُولٍ، عَنْ زَيْدِ بْنِ ثَابِتٍ، أَنَّهُ قَالَ: فِي الْبَيْضَتَيْنِ هُمَا سَوَاءٌ، قَالَ: فَذَكَرْتُ ذَلِكَ لِعَمْرِو بْنِ شُعَيْبٍ، وَنَحْنُ نَطُوفُ بِالْبَيْتِ، فَقُلْتُ: الْعَجَبُ لِمَنْ يُفَضِّلُ إِحْدَى الْبَيْضَتَيْنِ عَلَى الْأُخْرَى، وَقَدْ خَصَيْنَا غَنَمًا لَنَا مِنَ الْجَانِبِ الْأَيْسَرِ فَلَقَّحْنَ مِنَ الْجَانِبِ الْأَيْمَنِ.
Sayyiduna Zayd bin Thabit (may Allah be pleased with him) said: The two testicles are equal. Makhul (may Allah have mercy on him) said: While circumambulating the House of Allah, I mentioned this to Amr bin Shu'ayb (may Allah have mercy on him). I said: How strange of those who differentiate between the two! We castrated a goat on its left testicle, and it still mated from the right testicle.
وَأَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ، أنبأ عَلِيُّ بْنُ الْفَضْلِ، أنبأ أَبُو شُعَيْبٍ، ثنا عَلِيٌّ، ثنا عَبْدُ الرَّزَّاقِ، أنبأ مَعْمَرٌ، عَنْ قَتَادَةَ، عَنِ ابْنِ الْمُسَيِّبِ، قَالَ: قَالَ فِي الْيُسْرَى مِنَ الْبَيْضَتَيْنِ ثُلُثَا الدِّيَةِ؛ لِأَنَّ الْوَلَدَ مِنَ الْيُسْرَى، وَفِي الْيُمْنَى ثُلُثُ الدِّيَةِ، ⦗١٧١⦘.
Ibn al-Musayyib (may Allah have mercy on him) said: For the left testicle there is two thirds of the blood money and for the right one third, because a child comes from the left testicle.
قَالَ: وَحَدَّثَنَا عَبْدُ الرَّزَّاقِ بْنُ هَمَّامٍ، ثنا ابْنُ جُرَيْجٍ، أَخْبَرَنِي ابْنُ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ، قَالَ: فِي الْبَيْضَتَيْنِ الدِّيَةُ وَافِيَةً خَمْسُونَ خَمْسُونَ فِي كُلِّ بَيْضَةٍ، قَالَ: قُلْتُ: حَفِظْتَ مِنْهُ أَنَّهُ يُفَضِّلُ بَيْنَهُمَا؟ قَالَ: لَا،.
Mujahid (may Allah have mercy on him) said: For the two testicles there is blood money of fifty camels each. I said: Is neither of them preferred over the other? He replied: No.
قَالَ: وَأَخْبَرَنَا ابْنُ جُرَيْجٍ، قَالَ: قُلْتُ لِعَطَاءٍ: الْبَيْضَتَانِ؟ قَالَ: فِيهِمَا خَمْسُونَ خَمْسُونَ فِي كُلِّ بَيْضَةٍ وَرُوِّينَا عَنْ مَسْرُوقٍ، وَعُرْوَةَ، وَالْحَسَنِ، وَالنَّخَعِيِّ، وَالزُّهْرِيِّ: هُمَا سَوَاءٌ.
Ibn Jurayj (may Allah have mercy on him) said: I asked Ata (may Allah have mercy on him) about the testicles. He said: For the two of them there are 50 and 50 camels (50 for each). Masruq, Urwah, Hasan, al-Nakha'i and al-Zuhri (may Allah have mercy on them) say that the two are equal.
أَخْبَرَنَا أَبُو الْحَسَنِ الرَّفَّاءُ، أنبأ عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ، ثنا إِسْمَاعِيلُ الْقَاضِي، ثنا ابْنُ أَبِي أُوَيْسٍ، وَعِيسَى بْنُ مِينَا، قَالَا: ثنا ابْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنِ الْفُقَهَاءِ، مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ: فِي الْأَنْفِ إِذَا أُوعِيَ جَدْعًا، أَوْ قُطِعَتْ أَرْنَبَتُهُ الدِّيَةُ كَامِلَةً، وَالذَّكَرُ مِثْلُ ذَلِكَ إِنْ قُطِعَ كُلُّهُ، أَوْ قُطِعَتْ حَشَفَتُهُ، وَيَجْعَلُونَ فِي الْأُنْثَيَيْنِ الدِّيَةَ، وَفِي أَيِّهِمَا أُصِيبَتْ نِصْفِ الدِّيَةِ.
Abu al-Zinad (may Allah have mercy on him) narrates from the jurists of Madinah that when the nose is completely cut off, or its tip is cut off, there is the full diyah (blood money) for it; likewise, if the male organ is cut off entirely, or its glans is cut off, there is the full diyah; and for the two testicles there is the full diyah, and for whichever one of them is injured there is half the diyah.
