قَالَ اللهُ تَبَارَكَ وَتَعَالَى: {فَاعْتَزِلُوا النِّسَاءَ فِي الْمَحِيضِ وَلَا تَقْرَبُوهُنَّ حَتَّى يَطْهُرْنَ} [البقرة: 222].
Allah, the Blessed and Exalted, says: "So keep away from women during menstruation, and do not approach them until they are purified." [Surah al-Baqarah: 222]
أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ مَالِكٌ، عَنْ نَافِعٍ، أَنَّ عَبْدَ اللهِ بْنَ عُمَرَ رَضِيَ اللهُ عَنْهُ أَرْسَلَ إِلَى عَائِشَةَ رَضِيَ اللهُ عَنْهَا يَسْأَلُهَا هَلْ يُبَاشِرُ الرَّجُلُ امْرَأَتَهُ وَهِيَ حَائِضٌ؟ فَقَالَتْ: " لِتُشْدِدْ ⦗٣٠٩⦘ عَلَيْهَا إِزَارَهَا عَلَى أَسْفَلِهَا ثُمَّ يُبَاشِرُهَا إِنْ شَاءَ " هَذَا مَوْقُوفٌ وَقَدْ رُوِيَ مُرْسَلًا وَمَوْصُولًا عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ.
Nafi' narrates from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that he sent me to Sayyidah Aishah (may Allah be pleased with her) to ask: may a man be intimate with his wife while she is menstruating? She said: She should tie her lower garment (izar) firmly over her lower body, then he may be intimate with her if he wishes.
أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ، وَأَبُو نَصْرِ بْنُ قَتَادَةَ قَالَا: ثنا أَبُو عَمْرِو بْنُ نُجَيْدٍ، ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْبُوشَنْجِيُّ، ثنا ابْنُ بُكَيْرٍ، ثنا مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ أَنَّ رَجُلًا سَأَلَ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: مَا يَحِلُّ لِي مِنِ امْرَأَتِي وَهِيَ حَائِضٌ؟ فَقَالَ رَسُولُ اللهِ صلَّى الله عَلَيْهِ وَسَلَّمَ: " لِتَشُدَّ عَلَيْهَا إِزَارَهَا ثُمَّ شَأْنُكَ بِأَعْلَاهَا "، هَذَا مُرْسَلٌ.
Zayd bin Aslam (may Allah have mercy on him) said that a man asked the Messenger of Allah (peace and blessings be upon him): What is lawful for me from my wife when she is menstruating? He (peace and blessings be upon him) said: "Let her tie her lower garment (izar) firmly over her lower body; then the upper part is yours to do as you wish."

أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا الْعَبَّاسُ بْنُ مُحَمَّدٍ الدُّورِيُّ، ثنا يُونُسُ بْنُ مُحَمَّدٍ، ثنا عَبْدُ اللهِ بْنُ عُمَرَ بْنِ حَفْصِ بْنِ عَاصِمٍ، عَنْ أَبِي النَّضْرِ، عَنْ أَبِي سَلَمَةَ، عَنْ عَائِشَةَ رَضِيَ اللهُ عَنْهَا أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ سُئِلَ: مَا يَحِلُّ لِلرَّجُلِ مِنَ الْمَرْأَةِ؟ يَعْنِي الْحَائِضَ قَالَ: " مَا فَوْقَ الْإِزَارِ "، هَذَا مَوْصُولٌ وَقَدْ رَوَيْنَا فِي كِتَابِ الطَّهَارَةِ فِيهِ طَرِيقَيْنِ آخَرَيْنِ وَهُمَا يُؤَكِّدَانِ هَذِهِ الرِّوَايَةَ.
Sayyidah Aishah (may Allah be pleased with her) narrates from the Prophet (peace and blessings be upon him) that the Messenger of Allah (peace and blessings be upon him) was asked: What is permissible for a man when his wife is menstruating? He (peace and blessings be upon him) said: "Whatever is above the lower garment (izar)."
أَخْبَرَنَا أَبُو الْقَاسِمِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ عَلِيٍّ الْإِيَادِيُّ الْمَالِكِيُّ بِبَغْدَادَ، أنبأ أَحْمَدُ بْنُ يُوسُفَ بْنِ خَلَّادٍ النَّصِيبِيُّ، ثنا عُبَيْدُ بْنُ عَبْدِ الْوَاحِدِ، ثنا ابْنُ أَبِي مَرْيَمَ، أنبأ مُحَمَّدُ بْنُ جَعْفَرٍ، أَخْبَرَنِي شَرِيكٌ، أَخْبَرَنِي عَطَاءُ بْنُ يَسَارٍ، عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنَّهَا قَالَتْ: كُنْتُ مَعَ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي لِحَافٍ وَاحِدٍ، فَانْسَلَلْتُ، فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " مَا شَأْنُكِ؟ "، فَقُلْتُ: حِضْتُ قَالَ: " شُدِّي عَلَيْكِ إِزَارَكِ، ثُمَّ ادْخُلِي ".
Ata bin Yasar narrates from Sayyidah Aishah (may Allah be pleased with her) that she was with the Prophet (peace and blessings be upon him) under one blanket. I slipped away quietly, and the Prophet (peace and blessings be upon him) asked: "What is the matter with you?" I said: I have begun my menses. He (peace and blessings be upon him) said: "Tie your waist-wrap on, then come back in."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ أَبِي الطَّاهِرِ الدَّقَّاقُ بِبَغْدَادَ، أنبأ عَبْدُ اللهِ بْنُ إِبْرَاهِيمَ بْنِ أَيُّوبَ بْنِ مَاسِي، ثنا يُوسُفُ بْنُ يَعْقُوبَ، ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ، ثنا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ، ح وَأَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ، أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ، ثنا عُثْمَانُ بْنُ عُمَرَ الضَّبِّيُّ، ثنا مُسَدَّدٌ، ثنا عَبْدُ الْوَاحِدِ، ثنا سُلَيْمَانُ الشَّيْبَانِيُّ، ثنا عَبْدُ اللهِ بْنُ شَدَّادٍ، عَنْ مَيْمُونَةَ رَضِيَ اللهُ عَنْهَا قَالَتْ: كَانَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ " إِذَا أَرَادَ أَنْ يُبَاشِرَ الْمَرْأَةَ مِنْ نِسَائِهِ وَهِيَ حَائِضٌ أَمَرَهَا فَأْتَزَرَتْ " ⦗٣١٠⦘ رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ، عَنْ أَبِي النُّعْمَانِ، عَنْ عَبْدِ الْوَاحِدِ، وَقَدْ ذَكَرْنَا سَائِرَ مَا رُوِيَ فِي كِتَابِ الْحَيْضِ، قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: فَخَالَفَنَا بَعْضُ النَّاسِ فِي مُبَاشَرَةِ الرَّجُلِ امْرَأَتَهُ وَإِتْيَانِهِ إِيَّاهَا وَهِيَ حَائِضٌ، فَقَالَ: قَدْ رُوِّينَا خِلَافَ مَا رُوِّيتُمْ فَرُوِّينَا أَنْ يُخَلِّفَ مَوْضِعَ الدَّمِ ثُمَّ يَنَالَ مَا شَاءَ وَذَكَرَ حَدِيثًا لَا يُثْبِتُهُ أَهْلُ الْعِلْمِ بِالْحَدِيثِ، قَالَ الشَّيْخُ رَحِمَهُ اللهُ: قَدْ رَوَيْنَا تِلْكَ الْأَحَادِيثَ بِأَسَانِيدِهَا فِي كِتَابِ الْحَيْضِ.
Sayyidah Maymunah (may Allah be pleased with her) said: When the Messenger of Allah (peace and blessings be upon him) wished to be intimate with (i.e. lie close to) a wife of his while she was menstruating, he would instruct that "she tie her waist-wrap tightly."
Imam al-Shafi'i (may Allah have mercy on him) said: Some people disagreed with us about a man's intimacy with his wife and his coming close to her while she is menstruating, and said: We have narrated the opposite of what you have narrated; we narrated that he should keep away from the place of the blood and then take whatever (enjoyment) he wishes. And he cited a hadith that the people of knowledge of hadith do not regard as established.
