A slave woman is not to be married in addition to a free woman, but a free woman may be married in addition to a slave woman

أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيٍّ الْإِسْفِرَايِينِيُّ الرَّازِيُّ، أنبأ زَاهِرُ بْنُ أَحْمَدَ، ثنا أَبُو بَكْرِ بْنُ زِيَادٍ، ثنا يَزِيدُ بْنُ سِنَانٍ، ثنا مُعَاذُ بْنُ هِشَامٍ، حَدَّثَنِي أَبِي، عَنْ عَاصِمٍ الْأَحْوَلِ، عَنِ الْحَسَنِ قَالَ: " نَهَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ تُنْكَحَ الْأَمَةُ عَلَى الْحُرَّةِ ".
Al-Hasan (may Allah have mercy on him) said that the Messenger of Allah (peace and blessings be upon him) forbade that a slave woman be married in addition to a free wife.
وَأَخْبَرَنَا أَبُو حَازِمٍ الْحَافِظُ، أنبأ أَبُو الْفَضْلِ بْنُ خُمَيْرَوَيْهِ، ثنا أَحْمَدُ بْنُ نَجْدَةَ، ثنا سَعِيدُ بْنُ مَنْصُورٍ، ثنا إِسْمَاعِيلُ ابْنُ عُلَيَّةَ، حَدَّثَنِي مَنْ، سَمِعَ الْحَسَنَ يَقُولُ: " نَهَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ تُنْكَحَ الْأَمَةُ عَلَى الْحُرَّةِ "، هَذَا مُرْسَلٌ إِلَّا أَنَّهُ فِي مَعْنَى الْكِتَابِ وَمَعَهُ قَوْلُ جَمَاعَةٍ مِنَ الصَّحَابَةِ رَضِيَ اللهُ عَنْهُمْ.

This is mursal (a report missing the Companion in its chain), except that it is in line with the meaning of the Book (of Allah), and with it is the view of a group of the Companions (may Allah be pleased with them).

أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ، ثنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ، ثنا عَلِيُّ بْنُ مُحَمَّدِ بْنِ مِهْرَانَ السَّوَّاقُ، ثنا أَبُو يَحْيَى مُحَمَّدُ بْنُ سَعِيدِ بْنِ غَالِبٍ، ثنا يَحْيَى بْنُ سَعِيدٍ الْأُمَوِيُّ، عَنْ حَجَّاجٍ، عَنِ الْمِنْهَالِ بْنِ عَمْرٍو، عَنْ زِرِّ بْنِ حُبَيْشٍ، عَنْ عَلِيٍّ رَضِيَ اللهُ عَنْهُ قَالَ: " إِذَا تَزَوَّجَتِ الْحُرَّةُ عَلَى الْأَمَةِ قَسَمَ لَهَا يَوْمَيْنِ، وَلِلْأَمَةِ يَوْمًا، أَنَّ الْأَمَةَ لَا يَنْبَغِي لَهَا أَنْ تَتَزَوَّجَ عَلَى الْحُرَّةِ ".
Zirr bin Hubaysh narrates from Sayyiduna Ali (may Allah be pleased with him) that when a free woman is married while (the man already has) a slave wife, he should allot two days of the turn to her and one day to the slave woman; and it is not appropriate for a slave woman to be married while there is a free wife.
أَخْبَرَنَا أَبُو حَازِمٍ أَحْمَدُ بْنُ عَلِيٍّ الْحَافِظُ، أنبأ زَاهِرُ بْنُ أَحْمَدَ، أنبأ أَبُو بَكْرِ بْنُ زِيَادٍ، ثنا يُوسُفُ بْنُ سَعِيدِ بْنِ مُسْلِمٍ، ثنا حَجَّاجٌ، ثنا لَيْثٌ، حَدَّثَنِي أَبُو الزُّبَيْرِ، عَنْ جَابِرِ بْنِ عَبْدِ اللهِ رَضِيَ اللهُ عَنْهُمَا أَنَّهُ قَالَ: " لَا تُنْكَحُ الْأَمَةُ عَلَى الْحُرَّةِ، وَتُنْكَحُ الْحُرَّةُ عَلَى الْأَمَةِ، وَمَنْ وَجَدَ صَدَاقَ حُرَّةٍ، فَلَا يَنْكِحَنَّ أَمَةً أَبَدًا "، هَذَا إِسْنَادٌ صَحِيحٌ.
Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) said that a slave woman should not be married in addition to a free wife, while a free woman may be married in addition to a slave wife; and whoever is able to pay the dowry of a free woman should never marry a slave woman.

أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ، أنبأ الشَّافِعِيُّ، أنبأ مَالِكٌ، أَنَّهُ بَلَغَهُ أَنَّ ابْنَ عَبَّاسٍ، وَابْنَ عُمَرَ رَضِيَ اللهُ عَنْهُمَا سُئِلَا عَنْ رَجُلٍ كَانَ تَحْتَهُ امْرَأَةٌ حُرَّةٌ، فَأَرَادَ أَنْ يَنْكِحَ عَلَيْهَا أَمَةً فَكَرِهَا لَهُ أَنْ يَجْمَعَ بَيْنَهُمَا.
Imam Malik (may Allah have mercy on him) was informed that Sayyiduna Abdullah bin Abbas and Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) were asked about a man who had a free woman as his wife and wished to marry a slave woman in addition to her; they both disliked that he should combine the two.
أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ، أنبأ إِسْمَاعِيلُ الصَّفَّارُ، ثنا سَعْدَانُ بْنُ نَصْرٍ، ثنا مُعَاذُ بْنُ مُعَاذٍ، عَنْ أَشْعَثَ، عَنِ الْحَسَنِ فِي رَجُلٍ تَزَوَّجَ حُرَّةً وَأَمَةً فِي عُقْدَةٍ قَالَ: " يُفَرَّقُ بَيْنَهُ وَبَيْنَ الْأَمَةِ ".
Ash'ath (may Allah have mercy on him) narrates from al-Hasan (may Allah have mercy on him) that he said regarding a man who married a free woman and a slave woman in a single contract: "He and the slave woman are to be separated."
