أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ، أنبأ الشَّافِعِيُّ، أنبأ مَالِكٌ، أنَّهُ سَأَلَ ابْنَ شِهَابٍ عَنِ الزَّيْتُونِ، فَقَالَ: " فِيهِ الْعُشْرُ ".
Malik (may Allah have mercy on him) says that he asked Ibn Shihab (may Allah have mercy on him) about the tithe on olives, and he said: There is a tithe on them.
وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ، أنبأ أَبُو مُحَمَّدِ بْنُ حَيَّانَ، ثنا إِبْرَاهِيمُ بْنُ مُحَمَّدِ بْنِ الْحَسَنِ، ثنا أَبُو عَامِرٍ، ثنا الْوَلِيدُ بْنُ مُسْلِمٍ، أَخْبَرَنِي أَبُو عُمَرَ وَهُوَ الْأَوْزَاعِيُّ أَنَّ ابْنَ شِهَابٍ الزُّهْرِيَّ، قَالَ: " مَضَتِ السُّنَّةُ فِي زَكَاةِ الزَّيْتُونِ أَنْ تُؤْخَذَ مِمَّنْ عَصَرَ زَيْتُونَهُ حِينَ يَعْصِرُهُ فِيمَا سَقَتِ السَّمَاءُ وَالْأَنْهَارُ أَوْ كَانَ بَعْلًا الْعُشْرُ، وَفِيمَا سُقِيَ بِرِشَاءِ النَّاضِحِ نِصْفُ الْعُشْرِ ".
Abu Amr al-Awza'i (may Allah have mercy on him) says that Ibn Shihab al-Zuhri (may Allah have mercy on him) said: The Sunnah has been established regarding the zakah of olives that it is taken from whoever presses his olives, at the time he presses them: on what is watered by the sky and the rivers, or is rain-fed (ba'l), a tithe; and on what is watered by drawing water with a water-camel's rope, half a tithe.
