باب: ما يستدل به على أن المراد بهذا الكفر كفر يباح به دمه، لا كفر يخرج به عن الإيمان بالله ورسوله إذا لم يجحد وجوب الصلاة
Evidence that this disbelief means disbelief that makes his blood lawful, not disbelief that takes him out of faith in Allah and His Messenger, so long as he does not deny that the prayer is obligatory

Abdullah al-Sunabihi said: Abu Muhammad claimed that the witr is obligatory. So Sayyiduna Ubadah bin al-Samit (may Allah be pleased with him) said: Abu Muhammad has spoken falsely; I bear witness that I heard the Messenger of Allah (peace and blessings be upon him) saying: "Allah Almighty has made five prayers obligatory. Whoever performs their ablution well, offers them on time, completes their bowing and their prostrations, and offers them with humility and devotion, then it is a covenant upon Allah Almighty that He will forgive such a servant; and whoever does not do so, there is no covenant upon Allah Almighty for him: if He wills, He forgives him, and if He wills, He punishes him."

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "I have been commanded to fight the people until they testify that there is no god but Allah and that Muhammad (peace and blessings be upon him) is the Messenger of Allah, and establish the prayer and pay the zakah. When they do that, they have protected their blood and their wealth from me, except by the right of Islam, and their reckoning is with Allah Almighty."

Sayyiduna Abdullah bin Adi al-Ansari (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) was once sitting among the people when a man came and sought permission to speak to him in private. He (peace and blessings be upon him) gave him permission, and he spoke privately to him about killing a man from among the hypocrites. Then he (peace and blessings be upon him) raised his voice and said: "Does he not testify that there is no god but Allah?" He said: Yes, but his testimony is no testimony. Then he (peace and blessings be upon him) said: "Does he not testify that Muhammad (peace and blessings be upon him) is the Messenger of Allah?" He said: Certainly, but he has no testimony. Then he (peace and blessings be upon him) said: "Does he not pray?" He said: Certainly, but his prayer is no prayer. Then he (peace and blessings be upon him) said: "These are the very people whom I forbid killing." These are the words of al-Qattan's narration.

Umm Salamah (may Allah be pleased with her), the wife of the Prophet (peace and blessings be upon him), narrates that the Messenger of Allah (peace and blessings be upon him) said: "Soon there will be rulers (imams) appointed over you; you will approve of some of what they do and disapprove of some. So whoever disapproves"
Sulayman said: Hisham said: "(disapproves) with his heart is free (of blame), and whoever dislikes it is safe; but (the blameworthy one) is he who is pleased and follows (them)." It was said: O Messenger of Allah, shall we not fight them? He (peace and blessings be upon him) said: "No, as long as they pray."
