باب: : من قال: يجب على الرجل مكاتبة عبده قويا أمينا، ومن قال: لا يجبر عليها، لأن الآية محتملة أن تكون إرشادا، أو إباحة لا حتما

وَفِيمَا رَوَى عَبْدُ الرَّحْمَنِ بْنُ يَحْيَى، عَنْ حِبَّانَ بْنِ أَبِي جَبَلَةَ، قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " كُلُّ أَحَدٍ أَحَقُّ بِمَالِهِ مِنْ وَالِدِهِ وَوَلَدِهِ وَالنَّاسِ أَجْمَعِينَ ". أَخْبَرَنَاهُ أَبُو بَكْرِ بْنُ الْحَارِثِ الْأَصْبَهَانِيُّ، أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ، ثنا أَحْمَدُ بْنُ الْحُسَيْنِ بْنِ مُحَمَّدِ بْنِ أَحْمَدَ بْنِ الْجُنَيْدِ، ثنا الْحَسَنُ بْنُ عَرَفَةَ، ثنا هُشَيْمٌ، عَنْ عَبْدِ الرَّحْمَنِ فَذَكَرَهُ. هَذَا مُرْسَلٌ، حِبَّانُ بْنُ أَبِي جَبَلَةَ الْقُرَشِيُّ مِنَ التَّابِعِينَ..
Hibban bin Abi Jabalah (may Allah have mercy on him) says that the Messenger of Allah (peace and blessings be upon him) said: "Everyone has more right to his wealth than his children, his parents and all people."
