أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ، ثنا إِبْرَاهِيمُ بْنُ عَلِيٍّ، ثنا يَحْيَى بْنُ يَحْيَى، أنبأ ابْنُ لَهِيعَةَ، عَنْ بُكَيْرٍ، أَنَّ ابْنَ الْمُسَيِّبِ، وَأَبَا سَلَمَةَ هُوَ ابْنُ عَبْدِ الرَّحْمَنِ قَالَا: " وَلَدُ الْمُدَبَّرَةِ بِمَنْزِلَةِ أُمِّهِمْ ". قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَالْقَوْلُ الثَّانِي: أَنَّهُمْ مَمْلُوكُونَ، قَالَ: وَقَدْ قَالَ هَذَا غَيْرُ وَاحِدٍ مِنْ أَهْلِ الْعِلْمِ..
Ibn al-Musayyib and Abu Salamah bin Abd al-Rahman (may Allah have mercy on them both) both say that the children of a mudabbarah have the status of their mother (that is, in the matter of freedom and slavery).
