Bayhaqi 18047 — Killing polytheists after capture by striking

Hayyaj bin Imran al-Burjumi says: My father's slave ran away. He vowed: If I catch him, I will cut off his hand. When the slave was caught, he sent me to ask Imran bin Husayn (may Allah be pleased with him), and he said: I heard the Messenger of Allah (peace and blessings be upon him): "He (peace and blessings be upon him) would encourage charity in his sermon and forbid 'al-muthlah' (mutilation)." He says: Then he sent me to Samurah (may Allah be pleased with him). He said: I heard the Messenger of Allah (peace and blessings be upon him): "He (peace and blessings be upon him) would urge charity and forbid 'al-muthlah' (mutilation)."
Imam al-Shafi'i (may Allah have mercy on him) says: If someone says that he (peace and blessings be upon him) cut off the hands and feet of those who drove off his milch camels and put out their eyes, (the answer is that) Sayyiduna Anas bin Malik (may Allah be pleased with him) and another man narrated this from the Prophet (peace and blessings be upon him), and both of them, or one of them, narrated in it that after that the Prophet (peace and blessings be upon him) did not deliver any sermon without ordering charity and forbidding 'al-muthlah' (mutilation).
Imam al-Bayhaqi (may Allah have mercy on him) says: Abdullah bin Umar and Anas bin Malik (may Allah be pleased with them) narrated it, and this addition is in the hadith of Sayyiduna Anas (may Allah be pleased with him).
