أَخْبَرَنَا أَبُو الْحَسَنِ الرَّفَّاءُ، أنبأ عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ، ثنا إِسْمَاعِيلُ الْقَاضِي، ثنا ابْنُ أَبِي أُوَيْسٍ، ثنا ابْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنِ الْفُقَهَاءِ الَّذِينَ يَنْتَهِي إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ، كَانُوا يَقُولُونَ: " لَا يَنْبَغِي لِأَحَدٍ أَنْ يُقِيمَ شَيْئًا مِنَ الْحُدُودِ دُونَ السُّلْطَانِ إِلَّا أَنَّ لِلرَّجُلِ أَنْ يُقِيمَ حَدَّ الزِّنَا عَلَى عَبْدِهِ وَأَمَتِهِ ".
Abu al-Zinad narrates from the jurists of the people of Madinah: "No one should apply a prescribed punishment to anyone except the ruler (sultan); and if a man's own slave woman or slave commits adultery, he should apply the prescribed punishment to them."
