وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ، ثنا مُحَمَّدُ بْنُ رَافِعٍ، ثنا عَبْدُ الرَّزَّاقِ، أنبأ ابْنُ جُرَيْجٍ، أَخْبَرَنِي أَبُو ⦗١٨٨⦘ الزُّبَيْرِ، أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ، يَقُولُ: كَتَبَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: عَلَى كُلِّ بَطْنٍ عُقُولُهُ، ثُمَّ كَتَبَ: أَنَّهُ لَا يَحِلُّ أَنْ يَتَوَالَى مَوْلَى رَجُلٍ مُسْلِمٍ بِغَيْرِ إِذْنِهِ، ثُمَّ أُخْبِرْتُ أَنَّهُ لَعَنَ فِي صَحِيفَةٍ مَنْ فَعَلَ ذَلِكَ رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ مُحَمَّدِ بْنِ رَافِعٍ قَالَ الشَّافِعِيُّ: قَضَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَلَى الْعَاقِلَةِ وَلَا دِيوَانَ، حَتَّى كَانَ الدِّيوَانُ حِينَ كَثُرَ الْمَالُ فِي زَمَانِ عُمَرَ رَضِيَ اللهُ عَنْهُ.

Then he wrote: "It is not permissible that the freed slave of a Muslim man be taken as an ally without his permission." Then I was informed that he cursed, in a document, whoever does that.
Imam al-Shafi'i (may Allah have mercy on him) says that the Messenger of Allah (peace and blessings be upon him) placed the blood money upon the 'aqilah when there was no register (diwan); the register only began in the time of Sayyiduna Umar (may Allah be pleased with him), when wealth became abundant.
